I have tryed claiming under financial hardship with lloyds but hit a brick wall.I am now trying FOS has anyone had any joy with lloyds0

F/h sucess abbey, nwsm if your there could you help, abbey told me on friday over the phone that i have been granted f/h and the sum of £2459 will be refunded,but letter on the way, i have a debt with abbey of £1435, that i pay of £50 a mth to a 3rd party collections agency, i called them on friday and they said that if i pay in full they would reduce the debt to £1076 happy days, spoke to abbey again today as letter hasnt arrived, spoke to a man who read the letter to me, and they have sent me a cheque for £979 and a cheque to the agency for £1485, which is £409 more than they said they would settle on and £50 more than i owe them (£1435)how do i stand on getting the extra £409 back to me please help0

Do you have priority debt arrears(mortgage/rent/council tax, utilities)? If yes, did you make any arrangements to pay off the arrears?
Do you still bank with them?
Did you send any notice of arrears to them?
Are you aware that any offer is not made in full and final settlement of the account?
Did you claim back to July 2001?
You need to be aware the you shouldn't expect a payout because the bank does not have to pay out even 1p under financial hardsip. However, I would negotiate based on priority debt arrears against the amount offered.
Furthermore, the FOS won't necessarily change the offer to anything higher.0 -

If the claim is with the courts then start a new claim for the new charges, so first letter, LBA etc, etc,0 -
I have received a £1600 offer with a "full and final settlement" agreement to sign-if I accept and sign does this mean I will be unable to reclaim remainder in future ??or will this agreement be invalidated if test case is favourable?0

I suggest you do not sign their form but write back accepting as an interim payment and draw their attention to the FSA waiver which prohibits them from seeking a F & F agreement(16)
if the firm attempts to resolve a relevant charges complaint after 27 July 2007:
(a)
the firm must not seek agreement from the complainant that the resolution is in full and final settlement of the matter;
(b)
in relation to such complaints, if the outcome of the test case produces a result that is more favourable to the complainant, the firm must take all reasonable steps to pay any difference in the amount of compensation actually received by the complainant and that that the complainant would have been entitled if his claim has not been settled by the firm then; and
(c)
the firm must explain the implications of its approach and commitment;0 -
HELLO AGAIN NWSM, RE ABBEY PAYOUT THEY HAVE CONFIRMED IN WRITING TODAY THAT THERE IS A CHEQUE ON ITS WAY TO ME AND ANOTHER TO THE COLLECTIONS AGENCEY FOR £1485, AS I SAID BEFORE I OWE THE COLLECTIONS £1435 (which is £50 less than the cheque they are sending to them) BUT AS I TOLD YOU ALLREADY THEY HAD AGREED THAT IF I SETTLE EARLY THEY WILL ACCEPT £1076 WITCH IS A DIFFERENCE OF £409 THAT THEY WILL OVERPAY, HOW CAN I GET IT BACK, I FEEL THAT THEY ARE SPENDING MY MONEY FOR ME, AND I HAVENT GOT £409 TO BE GIVING AWAY, PLEASE HELP VERY HAPPY WITH OUTCOME, BUT VERY CONFUSSED.0
