    I had a claim for bank charges with Abbey (£4,000) which like evceryone else's was on hold cos of the OFT case so I went down the hardship route about a month ago and my7 case was heard and Abbey have offered me £2,300 which I will take. So case now closed. Never knew about hardship cases foe reclaims till Martin brought it up on this site. Just waiting for the cheqwue to arrive.

    You should get an income and expenditure from the bank, however, you can complete a common financial statement and send it with your letter
    Example below:


    Hi Thanks for that - di you think i need to hit them with the Financial Hardship gambit again or (threaten) go to Court or FOS ?:confused:

    You could threaten them with a feather duster if you want but I doubt they will be that bothered.

    I'm going by what I read on the sites home page, which mentioned either apply to the Small Claims Court for the amount claimed or submit to the FOS for investigation :confused:

    I am in a very similar situation! I am claiming for £3000 including interest, Halifax put £1300 in my account in £2007 stating this was a good will gesture and asked me to reject or accept the offer. I didn't do anything and just waited, they sent me a second letter saying that if they didn't get a reply from me within 14 days then they would assume I had rejected the offer. This was 2 years ago and my case is still on hold with the courts and they didn't take any money out of my account.
    If the case is lost at court (god forbid) could they ask for this money back? and secondly can I claim for further charges I have incurred making it 8 years in total, if so how do I do this.

    Any answers would be greatly appreciated.

    Add the last two years worth onto the claim since the FSA Waiver has meant limitations cannot be used to refuse to pay out.


    How do you add more charges onto your claim?

    I am sure it is in with the courts. I have paid court fee's (apx £150 from what I can remember) and recieved some documents stating that it is on hold. The documents are from a legal firm working on behalf of halifax.

    Does this make a difference to my claim?
  • I sent my 1st financial hardship claim letter to Barclays on 1st May. I received 2 letters (on the same day) with 2 weeks, 1st one was 4 pages long babbling on about court case etc and basically until that was over there was nothing they could do to help me. The 2nd letter was sorry for my financial hardship and enclosed a expenditure form to fill in which I did and sent it off the next day. I received a reply 2 weeks later saying you be pleased to know that your case has been sent to dept for these cases and if they need any other info they will call or write but should have reply with 10 days. That was 14 working days ago, I called them on wednesday last week and was told my claim is being looked at now and there was a letter on computer waiting to have the blanks filled in (her words not mine) should hear within a couple of days. Still not heard anything so called today (14th day) and was told my case was still being looked at no decision has been made yet and they will write when they decided. I told her I would give it til friday if no decision had been made I will take matter further. She duly said "You are quite within your right to do that madam but we have had quite a large influx of these claims to look at the moment and its all getting back logged" like it was my fault!!! But if my claim was being dealt with last week they should finish what they started shouldn't they???
    My bank account is a basic one so no overdraft but if my dd's go into red by even pennies they refuse it and charge me. To add insult to me I received a letter from barclays today to say my rent standing order was refused due to lack of funds !!! the reason for lack of funds was because Barclays took their charges for the month on the same day. I rang to sort this and they pointed out that if I'd read my statement correctly I would have noticed that at the end it states in writing that months charges would be taken on 5th!!! Can they do this ???:mad::confused:
    Sorry to have waffled but once I started typing there was no stopping me :kiss::rotfl:
