Bank Charges Financial Hardship Disussion

    Claiming financial hardship, followed all the processes so far, today received a letter from Abbey that seems standard, but reads this:

    "We appreciate your current situation and that, in particular you currenty have arrears. In this instance we have arranged to refund £477.52 of charges"

    They have already put this into my account, there was no previous mention of refunds. However, this is only just under a quarter of the charges being reclaimed. There was no description as to where this odd figure came from either.

    What do I do now?

    I'm going through the same process, but a bit further on than you. I sent the first template letter in April requesting a refund of £1700 charges (and counting, as they are still charging me), asking for a response in 14 days and within about a week, they'd repsonded saying 'no refund, but fill in an income/exp form and ring us to discuss.' So I filled in the form and sent it back to them, stating that I wanted a written record of my response and would rather not phone (not to mention the number they gave is only open from 8-6pm, whn I'm at work). I also put in details of previous attempts when I have asked them for help with my financial situation (going back nearly 4 years - meetings with the manager etc), and all they've done is offer me a loan, which isn't helpful. They've also done other things like return a dd for my rent, even though I had cleared funds, so I just added in all this info to help support my case. I then added in some of the text from the 2nd template letter, stating that I refer to my original claim for the charges to be refunded, and included a copy of my original letter and an updated list of charges which I've produced from online banking. I sent that at the end of May and got a response saying they are looking into my letter and will get back to me in due course, although I again asked for a response within 14 days, so we'll have to see what happens.
    If you haven't heard from them yet, and it's more than 14 days, I think you should write again, and try and add some details of priority debts which you are not meeting and add a copy of your original letter. Also, if you've got proof of delivery, that helps - I send everything recorded. Hope that helps, I'm sure you'll get better responses from others on here, who have gotten further in the process and know a bit more of what to expect!

    Minus the figure from what you are claiming and write to them and ask them how they have come to that figure.

  • i am just going to start my hardship claim, im with natwest, i have read that you can only claim from 2007 back, most of my charges are in 2008!!!! can i still put these down on my claim and do you think i will get then back?????

    You've misunderstood.Normally, under the Limitations Act, you can only go back 6 years from whenever you start your claim ie from now to 2003. But the FSA waiver 'stopped the clock' on 27th July 2007, which means that any charges from July 2001 are not subject to the 6 year rule and are still claimable

    sorry to be so thick, so i can claim back from todays date to 2001?? or is it just from july 2007 back to 2001 ??

  • We started a claim to Halifax in March this year for charges dating back to March 2003 (6years). This is now currently in the hands of the FOS.

    Having read the last couple of posts, it appears that we should have claimed from 27/07/01.

    Should we make a revised claim? The difference would be about £900 before any interest.

    Hi all, this is my 1st post, but I have been using the sites letters in respect of £3.7k reclaimation, against the Halifax.;)

    Basically they now state that the Hardship case will not be dealt (this is our final response) with :mad:and "if not satisfied" I should report to the FOS - should I head down the FOS route ?? Thanks. RF.
