I am 'attempting' to process my reclaim via the FOS under the hardship exemption, however when I attempted to chase it up today some 6 weeks after my initial application to them, I was suprised when I was told that it would be at least another 4 months before my case would be looked at by an adjudicator !! Has anybody else had a similar experience ? & if so, do you know of any way to speed up the process ??
Any feedback would be greatly appreciated !!
Have you tried through your bank? Do you have priority debt arrears(mortgage/rent, council tax, utilities)? Is the account still open?0 -
Hi there, I just wondered if anyone can help. I have completed the income and expenditure form with Nationwide last week. Today I have recieved a letter from them:
"Before I can consider refunding any charges could you please let us know what caused you to enter or experience Hardship and when it began and provide us with any evidence that will help us when we are reviewing your financial circumstances"
Is this significant?
I was made redundant Sept 08, but I also experenced hardship in 2004 / 2005 when my husband lost his job and we had our second child, I was off on maternity leave and it took a couple of months for him to secure a new role.
Are nationwide trying to avoid repaying the charges depending on my response?
I do have confirmation of my redunancy to send them. just wondered if I should tell them about 2004/2005 as well?

hi all , just need sum advice plz any 1, i contacted the f/o as tsb hadnt replied to my later bak in feb , 2 day i got a letter and it says

i think it would be helpful if i set out my understanding of ur complaint
you are suffering financial hardship and would like your charges to be refunded
i am sorry to hear that u are currently suffering fh tsb are dedicated to trying to help our customers who are struggling financially
our records show that the charges have been applied in line with the tariff of the account and are valid
therefore i am unable to refund charges that have been applied to your account
after viewing your accont i believe it would now benifit you to transfer these acconts to the control of our customer debt recovery deptment
however before your acconts are transferred to cdr we are required to send you legal letter adverse information will also be reported to credit reference agencies
i belive this will help your f/h situation as once your accounts are with cdr interest will be frozen and will given an opportunity to submit your repayment proposal. please make sure you have your details of your income and expenditure and other creditors to hand
i hope this fully answers the points you raised with us , please let me know if there is any thing else i can do for you
if we cannot come to an arragement i will provide you with details of the f/o so they can consider your complaint independently
theres no need to reply to my letter if u are happy and will close the complaint on the 27th of july and reopen if i go back

It might be worth reminding them that they cannot default an account where the amount is in dispute. There is an argument, that I think you can argue, that bank charges have been in dispute since the OFT test case began ie July 2007. If the charges are higher than the total amount that you owe the bank then I would argue on that basis. Stopping interest is fine and dandy but it doesn't help with priority debt arrears.0

hi, thanks for the info , but i owe tsb more than my bank charges, but i look at it this way if they paid me back i would be able to get out of hardship pay the arrears of me tsb c/c ,get back up 2 date on me loan , i know that if we do get our money back i will have to give all mine back to tsb but thats not a problem , i just thought in one way that if they refunded them least the money wouldnt excatly leave the tsb but help pay of my arrears and help towards paying of the rest of wot i owe then i could pay more to get me morgage up 2 date hope this makes sense lol thanks jill0 -
HI put a claim into HSBC Jan 2008 for £3340 told me claim on hold until court case, sent second letter this week. then they phoned me out of the blue have agreed i am in "financial difficulties" then offered me £200 as a good will gesture. i politley declined then they downgraded my account to a basic one what next?

I hate this but it is happening more, please please please stop declining refunds but try and negotiate for more.0 -
I helped my sister try to reclaim some charges from A&L through the financila hardship claim. It's been going on since the beginning of the year and the account was overdrawn and it was all through charges. She had a statement of her account yesterday and ALL the charges had been refunded so the account balance is back to 0. Result!!!!!0

Some Advice please....
I sent my 1st Template letter off to HSBC a month ago, stating they have 14 days to respond. As yet I haven't recieved a response. And yet again they have put another £125 charges on my account for this month. This is a never ending vicious cycle. I am struggling because I'm constantly paying back there charges. I am claiming under financial hardship.
Just wondered what the next step should be for me ?
Should I just be patient and wait, or should I keep bombarding them, in the hope they pay back my charges. Or go straight to the f/o
Is there a 2nd Template letter I can use ???
All help and advice is appreciated, as I'm really struggling atm:j Things can only get Better :j0
