    Hi mandij30
We are in exactly the same boat as you with HSBC. I was on the phone to them yesterday and got the same message but it was because they said we were not in hardship because of £5! According to them we spent £5 too much on "entertainment"! I checked the income and expenditure form copy and under entertainment it said NIL! we cant afford entertainment as we are in Hardship!
I am writing to them again pointing it out. I also told them that because we had over £500 of charges in the last 12 months then that was indicative of being in hardship...he then asked where I had heard that as he hadnt heard it before..so i told him and he went away to check and came back to say no that means that we can be assessed for hardship, nothing more, and they have found us not to be so.
    Mad!

HSBC are really ridiculous, I mean they even brought up a transaction for Mcdonalds I'd recently paid for on my Maestro Debit card. ( So I've struggled all month with nothing, so on Payday I decided to take my kids there for a treat) Jeez My incomings are £1138, and outgoings are £1083.

I'm certainly not living a life of Luxury, and with Bank charges of £600 so far since January 09 surely they can see there causing my financial problems by charging me £125 on the 23rd of every month when there is no money left in my account by then.

I wonder if It'l still be possible to continue with this claim, after the result of the test case. Seeing as they won't pay out now on grounds of Hardship

I've just been through the hardship claim process, and have today received a reply saying I've been rejected. The basis of rejection is that, despite the fact that I have enormous debts which are getting worse every month, so far I have always been successful in robbing Peter to pay Paul and have therefore not gathered any 'priority' debts. ie. I'm not behind on my mortgage, council tax or utility bills.

I sent in an Income and Expenditure form clearly showing that my income doesn't cover my expenditure, and outlining the change in circumstances that has led to this situation.

Surely by taking this approach the banks are actually encouraging us to default on the important stuff!

Apologies if it says that but since the OFT test case the bank doesn't really care that much. The courts will stay any claim and the FOS figures themselves on hardship show that their waiver isn't working as it was intended. The FOS since they specifically introduced financial hardship has seen a payout figure increase by 3 whole percent. It's hardly gonna trouble the banks really. If the FOS or rather the FSA are going to have a waiver in place then they need to really nail down some proper way of determining a financial hardship case. The £500 worth of charges a year is quite frankly a nonsensical approach as it would mean someone have two charges per month to get to the £500 mark with two months in hand for good behaviour.

Thanks for that - the banks seem to do what they want at the moment - theres some succsess stories but not many !! Do you think it best to contact them again with a financial breakdown (never before asked for), resons for hardship (again) I have 2.5k of Mortgage arrears at the mo ??
  • I am currently trying to claim hardship from Natwest. I have sent off my income and expenditure form and have priority debts (council tax, utilities), they have sent me a letter since, asking for evidence and documentation of other debts/credit cards. Has anyone else been asked for this? Do you think this means they will process my claim - asking for about 3k, since July 2007, this refund would make such a difference!

Yes, complete a common financial statement as the link below should give
    http://www.moneyadvicetrust.org/content.asp?ssid=38

And send that as well as copies of any arrears notices.

Unfortunately, the way banks are interpreting the FSA Waiver is on Priority debt arrears and the FOS will agree with that. The basis is that the ultimate sanction on a credit card is a default and possibly CCJ where you will make arrangement to pay what you can afford to your creditor(of course I would still argue you should claim PPI plus credit card charges first :D )

Alliance & Leicester have put me into a horrible financial position forcing us into IVA. Without going into details here, I just want to point out something that made me want to scream! The IVA company wanted a copy of my last 3 months bank transactions, something that A&L seemed to find extremely difficult to provide, anyway, after much hassle... they finally sent them to me.... not just the last three months but every transaction going back to January..... and EACH ONE WAS IN A SEPARATE ENVELOPE AND POSTED INDIVIDUALLY!!!!!!!! I'm sorry, but have I missed something here? I thought the bank charges etc were to cover their obviously very expensive administration fees? It's looks like there are some very infantile, bored office workers out there spending what little, precious money we have (that they keep taking from us)!:mad::mad::mad::mad:
