Hi all, ive just gone through the hardship process with both halifax and lloyds tsb. They both agree that i am in hardship but refuse point blank to repay my bank charges to me.. The only thing they would do is let me pay £5-£25 per month to them to clear my outstanding balance..
Does anyone know what I can do as they will not discuss it with me.. Especially Lloyds TSB with whom im dealing with their solicitors who have accepted the ammount each month to pay..
Any advice would be greatly appreciated0 -
I contacted Abbey with my details of hardship, filled in all there forms emailed all of the papers and sent originals by post. The outcome was that they only returned the money to cover the money that I owed them on there account and with a utility bill, this only came to under £300.
My claim is for £6472 with interest.
Can any one please tell me if this is correct that they can only give me the above money back. I am still in debt (over £15000) with credit cards and catalogues.
Thanks for help if anybody can help. I did email GM TV regarding this yesterday but to no avail.

Oh yeh I have gone through CCCS and they say were in hardship and so do Abbey but they say it's there policy only to return the above amount are they in the right?????????0

Hi, sorry if this is the wromg place to post, but can i try and reclaim if i am on a DMP plan? And also if i do will the people i owe money too demand thier money back straight away and start charging me interest? A bit confused . thanks0

My reclaim with the nationwide is on hold and although they accept i'm in finantial hardship the account is no longer my main account, and have said that as they are not adding to my problems with more charges, the hardship clause doesnt apply. The reason being that the charges are mainly from years ago whereas i'm in hardship now, ie its not their fault and they cant be accused of making my situation worse.
Is this right, because i feel that as i'm in hardship, it should be irrelevent whether i use the account for direct debits etc.0 -

In relation to "manipulation", it is not the dates that they are moving but deciding when to pay out or refuse to do so (both incur charges). There are times when there is no reason why some smaller charges are refused but now and again a big DD is paid - thus putting us into the red further. We have had situations where on a list of charges the earlier smaller sums that fell to be paid are not paid but later larger ones are. Mind you I am probably getting a little paranoid but it seems odd - they also.
In relation to the email to the Ombudsman, I went through the contact box on his webpage. I got an acknowledgement (received on 15 June) but no one has been in touch.
Does anyone have any advice on changing banks i.e. the pitfalls etc. - things to watch out for.

The first thing you need to do is to find out how much in total you have been charged since July 2001 or if you account was opened after that date then all charges on the account.
You then need to total up the charges and send a letter to the bank and argue financial hardship.

Hi first time on here and decided after my bank knocked me back for financial hardship with my bank charges to take them for as much as i can, ( have already appealed to the financial ombudsman). After they knocked me back i have now put in a claim for ppi which was sold to me more than 7 years ago, what my chances of winning this? My case i spoke about earlier is a claim i put in from February 2007 which dates back to Feb 01, can i also claim for the bank charges i have received since then which seem to be mounting?0

What about charges from a Ltd Company bank account where the Ltd Company has been dissolved, can you still claim as one of the account signatures/former Director etc?
Back to your initial question re Financial hardship with Nationwide, do you have priority debt arrears(mortgage/rent, council tax, utilities)?
Are any of the arrears being paid back through any payment plan?
Yes you can claim on closed bank accounts where you owe money and likelihood depending on the amount is that it would be deducted from any amount you would pay. You are unlikely to be able to claim financial hardship on those accounts.0
