Hello All
I have put in a case of hardship with Natwest for £1400 worth of charges and i am still getting charged at present for being over my overdraft limit. I recieved a letter saying that i was not in hardship because i was £60 in credit after i had paid my bills.
I have not made arrangements with Natwest to try and pay £130 per month to get my overdraft within its overdraft limit, which is £950, this will send me over my £60 credit so does that mean i would possibly be a better hardship case?
Any help would be great

I recently put in a claim under hardship with HSBC for £1880, and after filling in the income and expenditure form, they have finally come back and said I'm not in hardship (not sure how they got to that one, I've got a court summons from my council tax £800, and I'm £500 in arrears with rent, plus £200 deficit on my account every month after their stupid charges have been deducted), but they will give me a 'goodwill refund of £250.' I'd already written to the FOS before I received this letter, because prior to this, HSBC kept trying to fob me off, and have sent me a number of letters in response to my one letter, which I thought was out of order and deliberately confusing. Anyway, so FOS haven't got back to me yet, as obviously they're swamped, but I would really like some advice on what to do now. £250 is a joke, but I know Natweststaffmember has said on here before that it's best to accept the offer and then negotiate for more. Any advice on how I should go about this or if this is definitely the right way to proceed? I've also updated the FOS via email on the latest developments, and sent them copies of the arrears statements so they can see I'm in hardship. Do you think I should send these to HSBC and ask them to re-assess the £250?
What I did find funny is that they said 'you're not in hardship and we won't be refunding you under the hardship waiver, but we will give you a £250 refund.' Sounds like a round-about way of saying they're guilty as charged...

I am slightly refining the approach now. I think you need to document a few things which will help at ombudsman stage. Firstly, you need to try an write down the cause of your inability to cover priority debt arrears, for example, losing your job, separation(so loss of a second household income) etc,etc, The next part is the effect of the charges on your ability to repay priority creditors(mortgage/rent, council tax, utilities). Once you have done that, you need to state the full amount of your claim going back to July 2001 or from the start of your account being opened.
This is the bit you need to consider, how much money from that claim can be used to clear priority debt arrears and furthermore, put you under your overdraft as well.
So you could argue that you would like x amount paid back to cover priority debt arrears, y amount to cover debts to existing bank plus perhaps suspension of charges for say 3 months to allow you to sort out your budgetting issues.
Once you have negotiated on that basis and they come back with a final response, then we can work through their response.

The basic answer is yes but the rest of the charges are still live so to speak. Anything they don't refund now will be dealt with on the conclusion of the OFT test case0 -

Hi once again thanks for responding.
At this time I do not have debts i.e. overdue arrears etc (unless you count going over the limit on my credit cards). I am having problems meeting the minmum payments though. Most payments (if not all are late) but I am paying them but running out of money within days of getting paid. Quite hard to feed a child with no access to funds.
I have submitted two claims to BoS totalling about 6k but have received the "we will not correspond further" letter. I feel that I am just hitting a brick wall.0 -

£300 for 2 kids every month to the ex, £200 for a default on a credit card a month,£178 bank loan and £160 rent to my parents as i had to move in with them as i couldn't afford a place of my own and thats before i need to pay my credit card bills, direct debits, travel expensises to work and mantienence on my car etc all from £1300 a month0

I have two claims with Lloyds yet despite them admitting financial hardship and despite telling them about the fsa waiver for them to deal, they still refuse to deal. All they keep stating is that a test case is still in court.0
