can anyone help??
i recieved a letter from the a&l yesterday stating that they have thoroughly investigated my request under financial hardship and are satisfied that the fees have been raised correctly in accordance to there current account fee structure.
they go on to say taking into account your personal circumstances they have agreed to refund fees totalling £50 which has been credited to my account!!!
they also say that it would appear that you have sufficent disposable income in order to meet your current financial commitments and reasonable living expenses they therefore cannot consider my claim under financial hardship.
what can i do next??0 -
would my rent arrears not count as a priority debt??0

yes they would - its very difficult to say why they have made the decision without seeing your income expenditure sheet.LegalBeagles0

Hi, I recently wrote to HSBC to claim for rembursement of my bank charges which total £1,500. I have to say HSBC have been very quick in responding, I have just received a letter explaining that I will need to proove I am in financial hardship, I must admit I do find this a strange way of going about it as they can easily see from my account I dont have have enough income compared to my outgoings but I guess this is there way of seeing how much you need it. Anyway, the letter stated that I am to fill in the income & expenditure enclosed then call them to discuss the matter. I have filled this in & every month I am short by £140, I am also now entering a Debt Management Plan with PayPlan so this should hopefully help matters.
I plan to call HSBC in the next day or so to see what they say, Im guessing they will try to get out of paying. I would be happy to except £1000 to be honest but dont hold out much hope! Think the templates and guidance on here are brilliant. I will update along the way too. Any other advice or experiences would be gratefully received.0 -

I wonder if someone can advise me, I reclaimed against HSBC two years ago and won, however, I still never got myself on track and is starting another claim today against them for nearly £3500.00. I have use the hardship letter. I really don't know what will happen now after I sent the letter today. Is it wise claiming from the bank again.0

Just need a bit of advice. I have an overdraft with Natwest that was originally for $400 (for some reason my keyboard does not have a pound sign). I've been on a DMP since Feb 09, but reinstated DD's have now resulted in constant charges making my overdraft nearly $800. What I'm paying through the CCCS nowhere near covers my monthly charges from Natwest. Can I make a claim through the hardship criteria ??I'm always in the brown stuff (marmite)....only the depth varies!!! :rotfl:0 -

I wrote to the Nationwide asking for my charges to be refunded with interest on the grounds of financial hardship. I'm bankrupt, single parent of 3 on benefits. They then replied with a statement of means form which i filled out and returned. I then got a letter back stating that as all my charges were prior to October 2008, when i received sufficient income to cover my expenditures, they were unable to meet my request for payment. I went bankcrupt in July 2006. Does the hardship pertain to now or then or is this just a delaying tactic by the bank? All advice would be greatly appreciated.

F. hardship claim with nationwide.
Back on the 16th May 09, I decided to finally contact NW and reclaim bank charges totalling £1204 with interest £1505.
Within a week a recieved a letter with a statement of means form, which i completed, and as per one of their options i called through with the information as opposed to sending it off.
I then got told by a young girl, that i could only claim bank to when my f. hardship started ( when i seperated from my ex partner in Nov 08). I stated that no where in the FOS statement does it say this and they are trying to "pass me off".
So i sent another letter off, stating that they have not satisfied their duty, and have not considered my claim.
I waited a week, and called to see if they have receievd the letter, they said no. I asked do they have the information regarding my statement of means form to which i completed over the telephone, they said no!. They have lost it and asked me to send the original in the post.
I sent the orginal with another form letter highliging their conduct and neglect. including the original statement of means form and again a list of my charges. I included names to whom i have spoken to etc.
that was back on the 8th June, I contacted them yesterday to ask if they recieved my letter. They said they havent, and then after a heated conversation i was cut off!? I waited until today to calm down and contacted them again, suddenly my letter was there, and i was put through to a senior person who read out a repsonse they sent me on the 22nd( although i havent had anything) to say they are not paying my charges, after a review etc etc.
I then asked this chap on the phone to note their file that i will be contacting the FOS. As soon as i said that, he asked me to hold and said i will need to go through the internal complaints process again and raise the complaint as a stage 2 complaint ( senior managment).
I cannot believe that they have looked at my statement of means form and still refused to pay. I am losing £200 per month getting more and more in debt.
Can anybody shed any light on this? or give me some advice? Has anybody had any experince with nationwide?
Nationwide, appear to be delaying mine. I wonder what stage 2 complaint is?0
