    Hi all.

Having been struggling for months and months, I have decided to get my house in order and start to sort everything out. Better late than never eh :)

So, I am putting in a claim. I am not bothering with interest, and have worked out my claim to be £2901.

Now, my aim is to prove that I am in hardship. I am planning a 2 fold argument. 1 - I have incurred over £500 charges in the last 12 months. 2 - I have 2 debt collection agencies after me(not for great amounts but still...).

I was thinking of including some correspondance from one of the agencies, to try and highlight my hardship. Would this be advisable? Any other thoughts and tips would be very much appreciated.

I will, of course, keep everyone updated as I go along :)

I wrote to the Nationwide asking for my charges to be refunded with interest on the grounds of financial hardship. I'm bankrupt, single parent of 3 on benefits. They then replied with a statement of means form which i filled out and returned. I then got a letter back stating that as all my charges were prior to October 2008, when i received sufficient income to cover my expenditures, they were unable to meet my request for payment. I went bankcrupt in July 2006. Does the hardship pertain to now or then or is this just a delaying tactic by the bank? All advice would be greatly appreciated.
    Thanx
It's financial hardship NOW not then.

1 C/C and electricity bill, they are the only Priority Debts, but repayments to others means i'm struggling to make ends meet....

"I contacted them yesterday to ask if they recieved my letter. They said they havent, and then after a heated conversation i was cut off!?"

I always send my letters recorded delivery or special delivery after they "lost" 3 of my letters!

    Hi All, advice please!

I've had my claim with Barclays on hold since last year and have written to them requesting a refund on the grounds of financial hardship due to my wife losing her job. I've received an income and expenditure sheet and have some questions for those who have filled one in...

The first part asks to fill in borrowing commitments. I have a DMP with the CCCS so should I just put this as the commitment or do I need to detail each creditor and how much they receive from the DMP? Reason I ask is there is space to detail debts with Barclays, which I do have, however if I do get a refund I want it to be paid to me rather than to clear the Barclays debts..

Also, it asks for my bank account details (i'm not with Barclays anymore). Any idea why this is? Are Barclays able to check with my current bank for any information about my account?

I'm sure the majority of people slightly exaggerate their circumstances when applying under financial hardship, but are the banks likely to find out??

    Thanks all!

Credit card isn't priority debt arrear but electicity bill is. Are you making arrangements to pay back the arrears with the bank?

  • Hi all i wrote to my bank BARCLAYS about a week ago demanding they refund my money back under hardship. Got a reply today saying that they well not refund my money because they wrote to me in june 2008 to advise me that they were making significant changes and the change they made was to change the charges from £30 to £8.00 this is after the first test case was heard and that the banks lost..

    What should I do next?
    PLEASE HELP.
