Hi all i wrote to my bank BARCLAYS about a week ago demanding they refund my money back under hardship. Got a reply today saying that they well not refund my money because they wrote to me in june 2008 to advise me that they were making significant changes and the change they made was to change the charges from £30 to £8.00 this is after the first test case was heard and that the banks lost..

    What should I do next?
    PLEASE HELP.

Did you opt out of the reserve account ?

Are the charges ones incurred before or after august 2008 ?

When would you say your hardship began ?

Tell her to stop worrying cos they can't do that. The FOS would not be happy if they did this.

    Hello all,

After recentlt getting £1000 odd back from Barclays due to being out of work and in hardship, I wrote to Halifax on 19th May requesting hardship is looked in to with them.

They wrote back on 9th June asking me to complete the Beudget Planner which I did and sent back to them. They also advised I would get a copy of my charges shortly.

I called them Monday to say I hadnt heard anything and was told I would get a reply this week and the lady I spoke to said she would get my charges out to me that day.

So I called again today and was told still no charges list has been sent out (I originally asked 19th May and sent a cheque for £10) and that they had assessed my case and they accept my claim for hardhsip but they will not be paying out to me and instead have referred me to their money management team as the next step.

So I told the man on the phone I did not accept this and he said there is nothing else they can do for me at this stage.

I advised him I would like a claim with the FOS to which he replied 'there is no point as the test case is on hold and we do not have a responsability to pay you' to which I replied that if they have accepted my hardship claim then they do have to look at helping me and I would be going to the FOS.

So...where do I stand now, am I right to be going to the FOS now and if they have accepted my hardship then they should be paying me shouldnt they?

    Thanks. Karen

One other thing I forgot to menton was that they told me they cannot look in to the claim for one of the accounts as they close this account a few months ago - but this account is the one with all the charges on it? Do I have the right to claim if they closed the account?

Hang on, you sent a letter for a list of charges with the £10 and the next thing they said was you couldn't have them?
Did they send the list of charges out to you?

If you are in financial hardship the bank do not have to pay out.
