Hi just trying to understand what my harpship claim award means. Basically I've claimed £1633 and have received an offer of £550 which has already been paid into my account. What I would like to know is, if I accept this amount, does this make the original claim classed as dealt with? The reason I ask is that the bank account in question has an overdraft of £600 on. This amount clears that (well nearly), but as I am CCCS this overdraft will be removed from my account as under the terms I can have no active overdraft facilities that they are anaware of, and if they are aware of it (which they are), then it is treated as a debt, so cannot be my main bank.
So basically, this offer is of no use to me, as the money is not really available. Accepting this would clear my overdraft and leave me in the same situation, which makes me think that I should reject the offer and continue with the full claim. I am still in hardship, with bills just about being paid (well apart from electricity and gas but they have to wait and I'll arrange a higher repayment amount when the red letter comes!)
Any advice welcome?0 -

Have been attempting to reclaim bank charges due to financial hardship and have just been told I don't qualify as being in financial hardship by hsbc despite having to live with my parents where I am now in rent arrears as well as being unable to pay my bills and my loans etc which is way over 80 pounds per month with further bank charges of anywhere from 50 to 150 pounds per month being levied on my account they seem to think that my whole £50 of jobseekers allowance means that I am financially fine- even with letters threatening me with bailiffs- the only reason my outgoings on food etc are so low is that I haven't been able to take any money out of my account for 6 months and am therefore living off money borrowed from family and friends, they told me to ring back if my situation became worse unfortunately if my situation were any worse I would probably not be able to get in touch as it would mean my parents would have got so sick of subsidising their fully grown daughter that they chucked her out in which case I would be- at best- sofa surfing. Was just wondering if anyone has any advice- and let's face it letting off some steam.0 -
The bank account is the only one we use...
The arrears on the mortgage are the ones that we are struggling to pay back...0 -
natwesttaffmember- yes i do. They have already agreed i am in financial hardship. I just want to know when do i go to the FOS? 8 weeks from first letter, or 8 weeks after i said that would accept it as a partial settlement without prejudice. The 8 weeks will be up in under 2 weeks if its from september 21st. Its just so if i call them i can tell them that. Thanks.0

Can I clarify, priority debt arrears or other arrears?

Hi NatWest, nope, no priority debts as I always made sure I paid those bills even if it meant I couldn't keep up with non-priority payments. But I've had loss of earnings over the years due to medical condition (covered by DDA). I did get a refund of credit card charges 3 years ago, didn't know I could apply again?
Lloyds current accounts have been 'dormant' for 14 months, i.e. have made no withdrawals or anything from them since Sept 2008. Salary is now paid in to separate bank on advice of CAB as OD was swallowing up my salary. Basically I'm paying in to OD'd accounts on payment plan but Lloyds keep reducing the OD limit every time I pay in - they do it so that even with my monthly payment, the new limit gets breached, I get penalty charges and the debt gets bigger. So I was after an arrangement so that my payments would actually mean something instead of going into a bigger black hole each month...0 -

I don;t think you have a case for financial hardship from lloydstsb since you do not use the account as your main account. You can reclaim credit card charges at any time since there is no hold on those sorts of claims.0 -
Yes, i have rent arrears and council tax arrears amongst others. I am repaying th rent arrears but cant afford to pay the council tax ones or much else at the mo.0
