  • Dan, no court will decide to proceed with a case on Bank Charges since there is a blanket stay on all cases going through that route which is why I was asking about what happened with the Ombudsman because that is the only route available and they do not have to refund 100% of the charges back.
    You are reclaiming credit card charges as well, aren't you?

    Can you put in for credit card charges in the same claim then?? As i haven't done that. I have only incurred around £60 on my c/c anyway.

    When i contacted the Ombudsman they informed me that i should be trying with the bank to sort out and streamline my finances with them. The reason being was that all i had done with the bank so far was put several request and follow up letters for bank charges and not actually tried to come to any arrangement about my hardship. When Lloyds eventually admitted i was in hardship (Thanks to the Ombudsman) all i had was a 15min conversation with someone discussing how i could better organise myself. I was so annoyed at being treated like a child being shown how to eat with a knife and fork that i just went down the court route.

    Im also a little confused to why the bloke from court said to me last week that i should be putting a letter in requesting that my case be heard now at the local court.

    What is my best route to go down now? Letter to court or follow up with the Ombudsman??

  • I applied for my bank charges to be paid back to me 3 years ago when HBOS informed that they would not do it. I sent letters and telephoned them and again I was told I was to pay them back in full or they would take me to court..I was unemployed and could not pay them back..My mum paid my overdraft charges off which we were told would stop these charges but they didn't. I was made to pay them back to their own collections company I agreed to pay back £5.00 per month for both my credit card and my unplanned charges.They have made me increase both amounts by £6.00 I am on long term benefit and I do not work because I have a long term physical illness..every 6 months they said they would be increasing it or they would take me to court...I was advised to try and send the letters again and again they said my accounts been closed and I should continue to pay my charges back..
    I have had the same problem with lloyds tsb they cancelled a direct debit and I did with the company also and they are still taking a standing order off when it was cancelled and again more charges I got a letter this morning saying the charges are fair and that they would not be giving me my charges back..So I have went to the next step but until then I will still be being charged and receiving harrassing phone calls more than 10 times per night either on my mobile or or my house phone it just wont stop..I know they are going through a test atm but I was reading that in some cases they were giving you a token payment as such giving you something back but not in my case..Is there anything else that anyone could give me advice on????

    Credit card claim is separate to bank charges.
    Furthermore, have you streamlined the account, ie got rid of all non essential Direct Debits?
    Letter to the court asking for it to be transferred to your local court is what I am assuming they meant.

    Firstly request details from both banks on the current account and credit card. On the credit card ask for all data since the card was opened.
    Claim the bank charges back and claim all the credit card charges back which I suspect will wipe out that debt potentially.
    Do you have priority debt arrears(mortgage or rent, council tax, utilities)?
    Did you cancel the standing order before it went out and how long beforehand?

  • Hi, i wrote to lloyds tsb in june claiming approximately £800 charges. I tried to go down the hardship route. Maternity pay has now stopped and I receive £160 per month in child allowance and working tax credits combined.

    I have no arrears with priority debts and have approximately £1500 debt with payday loans.

    I am on a payment plan with them and pay about £120 per month to these various companies.

    I am trying to claim from lloyds tsb.

    Does anyone have any advice on how i could get them to look at my claim again or do i not qualify for hardship? the only 'debt' i have to lloyds is an overdraft of about £70 i pay at £7 every 4 weeks.

    Sorry i didnt specify. And yes, the person i spoke to told me that i should write to the court asking them to hear the case now once its moved to a local court.

    What would you recommend i do?? FOA?? or court??

  • Hello, I wrote to halifax asking for about 500 pounds charges to be refunded. They send me a letter asking for a proof that I am in hardship. What do I need to send them as a proof. I have a small child and get housing benefits and some tax credits. My husband has been out of work for over a year. We have three credit cards, loan and 2 overdrafts. Will the bank have to accept letter from council saying how much benefits I get, which is basicaly a proof that I dont have any income.

    Also my barclays account charges me 22 pounds a week if I go over my overdraft which is 200 pounds. Can I claim this back or is this new lower charge actualy legal.

    same here with the halifax, they sent a income and expen form and a letter stating, that the case is going through the courts. How can get bank charges back, when they ignore the letters, we send !!!

    I wouldn't recommend the court route because I don't think it would be successful.
    FOS again perhaps.
