In recent year i have had a lot of debt problems with unsecured debt of around £24k. For the past 6 month i have been paying in to an IVA. Recently i have been forced off work due to long term illness, and am currently living on incapcity benefit.
I am now in danger of loosing my IVA, i cannot keep up with household bills i have sent details of this to the halifax, along with my statement of benefit letter and all manner of supporting evidence and a budget sheet.
Halifax do not consider my case to be financial hardship, not only are they unwilling to pay me the £600 i am owed they also continue to take charges from my already reduced income.
What should i do?
Do you have priority debt arrears(mortgage.rent, council tax, utilities)?
Have you got credit card charges(much easier to reclaim and hopefully reduce that debt you have)?0 -
Hubby was taken to court by natwest for a loan debt he had with them, he asked Natwest to have his case looked at under hardship re claiming for his bank charges, this would have helped toward paying off some of the loan. But Natwest refused. He is unemployed and the only income is my wages which they are taking into account and because I pay our bills on time, they refuse to escalate his case.
What can he do?Debt Free!!!0 -

I don't mean to scare you but alliance and Leicester withdrew my overdraft when i claimed financial hardship. When i complained to the ombudsman they said as a&l had sent me a letter (which i never received) and now offered to reinstate it (after making £175 in charges from removing it), they were not in the wrong! It is so scary what they're allowed to get away with. If you can, i would recommend you and your wife set up an account with another bank if you can, just in case.0 -
Hi
I have just submitted my hardship claim to HSBC for £3220. I lost my job in the recent recession having spoken to HSBC today. They said they they did not consider payments to credit cards and a matter of hardship and as such only considered general living expenses (Rent etc)! My commitments to my credit cards are over £150 alone per month as I had to pay council tax etc and rent using them!
They then offered me £170 yes £170 and say that they would review the rest in 2 months as they review on a two month basis, unless the test case has occured!
Gutted and gobsmacked to say the least, have now gone the the FSA, surely this cannot be right? anyone have a simular experience?0 -

Please please stop rejecting offers but accept and negotiate based on the FSA Waiver on Bank Charges. You need their(HSBC) final response outlining their reasoning. If you have charges on your credit card then reclaim them.0 -
Hi,
I was just after a bit of advice please. I had succesfully claimed from Barclays Bank under Hardship and received about £1700 of a £2500 claim. I have now recently discovered that I am due to be made redundant at the start of October and so I was wondering if you guys thought it would be worth trying to claim the remaining amount?
Things are going to be hard for my wife and I unless I get a new job that pays as well as my last, we will really struggle as she is on maternity leave and due mid-October and with me being out of work too, I am a little concerned for our financial well-being!
Thanks in advance for your assistance
Dan
[EDIT] Actually don't worry, I just called Barclays on 0845 300 5857 and they said there was no way I would receive any remaining amount until the test case had reached a verdict in the customers favour. Ah well, it was worth a try.0 -
Hi, I've just joined the forum, for many years i have been charged for unpaid Direct Debits by Abbey National, I dont have my old statements nor am I on online banking.
My husband and i seperated 15months ago and the the bank charges are getting worse due to him being out of work at minute so not enough money is going into the account to cover everything.
How do i start to reclaim these charges without the evidence? i know i had over £300 taken off in july for bank charges!!0 -

i have been told by abbey 3 times now that they think im not eligable for financial hardship..even though i have about £17000 i debts including..
rent arrears to mother in law £3200, credit cards, overdraught, loan from previous bank account.. had 6 months unemployment, wife was on maternity for 12 months nearly..
they said we're not eligable.
WE've recently had to increase our overdraught to pay off MORE CHARGES!! we;ve incurred .. also got a £1000 water,£1000council tax,£1000 housing benefits bill to pay.. so i sent another letter with these added to our existing debts...we also had more outgoings than ingoings for 2 months running..(the reason they didnt listen last time was we had more going in than out)
we have a court summons for the council tax... do you think abbey will listen this time and help?0 -

Is there a tenancy agreement or documentary evidence.
, credit cards
That is classed as non priority but have you reclaimed the charges on that one including the £12.00 charges?

Non priority debt

Details of their process is outlined here and you just need to register to print out the form and view other successes. I am NWSM there as I am here.

The above is about financial hardship and if you see the post above this one it has a link to legal beagles with the I&E form specific to Abbey.0
