Bank Charges Financial Hardship Disussion

I put forward a financial hardship claim with Barclays for £2303. I received a letter at the weekend to say that they accept my claim and as a gesture of goodwill have paid £1173.75 in to my account and state that they have now closed my financial difficulty claim.
Obviously I am not happy with and I have also received additional bank charges since I sent my claim to them.
I would be really grateful if someone can tell me what I need to do next to claim back the rest of my charges. Do I now go down the court route?
Many thanks

Can you live without that £1173.75 until the end of the test case?LegalBeagles0

Most probably not, I will still be overdrawn every month by approximately £1500 so will continue to get bank charges. it would be great if i could get it all back as it would really set me on my way to getting all my debt sorted once and for all...0 -
Accept the £1173 and then ask for more. Use it to pay priority debt (rent/co tax etc) and any left to reduce the overdraft.
Are you living in your overdraft and have you considered starting over at a new bank with a basic account and no overdraft and arranging a repayment plan on the overdraft you leave behind ?
Are you incurring bounced payment charges etc or just the monthly authorised overdraft fee?LegalBeagles0 -
I have borrowed thousands of £££'s from family over the last couple of years ,especially the last year when in serious straits. When filling in the Expenditure form for an hardship claim, how does this work as i know it's informal debt, but how do you prove it???0

Thanks Esmerellda, yeah, I am constantly living in my overdraft and reserve, in arrears with one of my loans and getting charges for unpaid DD's.
I have considered to moving to another bank but thought it might not be possible whilst still being so overdrawn. Perhaps I will look in to this.
How do I go about asking for the rest, is there a letter template on here that I can use and am I going directly to the bank or the FOS?0 -

I was with HSBC and in serious debt and over the overdraft and faraway backed up with serious missed payments. We risked going to A&L to set-up a parchute account as were taking on some reclaiming with HSBC. A&L gave is the account no problems, and we've even found out that most of our bad credit (loans) from the past were with them, so believe me it's not a dead loss going to set-up another account.0 -
Hi
Can anyone advise me.
I started my claim with Halifax, then went into hardship and filled out all the financial statements.
Then they said someone from the manangement team would contact me to see if they could help which i knew they couldn't so she went back to them and said there was nothing she could do.
My claim is for £4756.00 and they offered me £105.00 cause i was in hardship which i spoke to someone and said i didn't want to accept that because it didn't even cover the cost of the bank charges they had levied on me that month alone and she said well it's up to her.
I told her i'd already been in touch with the FO and they have everything on file and i would get in touch with them and let them know what they had offered me.................was i right to reject this offer or not as it will not clear me from getting bank charges every month?
Any advise
Thanks

I was wondering if anyone could help? I put in a claim under financial hardship for 1,697.00. After the second letter they sent me an income form to view my ingoings and outgoings.
To my surprise about 3 weeks after sending the income form back to them i recieved a letter saying they were refunding £1,260.00 into my account and £20.00 of pending charges will be removed.
The letter also stated this:
"When reviewing cases of financial hardship we look for a change in circumstances that impacts on the account by causing a reduction in income or more charges to be incured. Our records show that in August 2005 there was a significant reduction in the income recieved into your account all charges since this time have been refunded".
My argument is, when they refunded me the money my account was overdrawn £211.48, from some of the bank charges they had applied to my account that i did not pay. So £211.48 was taken imediatly from the £1,280.00 leaving me with only £1,068.52.
Please can someone let me know, are they allowed to do this?0 -

The remaining charges remain on the table until the conclusion of the OFT test case issues.0
