Hiya im new to this thread so forgive me if i sound a little thick !!
I'll start with a bit of basic info ! Were currently dealing with the CCCS to set up a DMP as were struggling with our spiralling debts,(mainly caused by my OH on short time due to the recession and stupidly using credit to pay our credit!!) We bank with Lloyds TSB & have some of our debt with them namely x2 credit cards,x1 loan plus x2 overdrafts for 2 of our accounts, We are behind with 1 of the credit cards and Lloyds reguarly help themselves to money when money is actually in our account !!, Our accounts have been transferred to collections nad were paying back 1 of the overdrafts £40pm , anyway i recently appiled for our charges which total over £3k under the financial hardship window,i have just recieved their reply that agrees " following our initial investigations it may be that you are experiencing financial difficulties" etc etc they have sent a copy of our letter to collections team to see if they can do anything to help ?? basically they have said they do not think "you have provided any evidence that shows your situation has had a negative impact on the way your account has been been handled" so basically they say they have said my claim is on hold until the outcome of the test case !!, so where do i go now ?? can i phone,write again or complain to the FOS ?? Anyone got any experience on my chances ?0 -

Did you actually receive any bank charges since you went into their collections team and started paying back the overdraft?0 -

Most of the charges are from 1 account, the account that went to collections is no longer used just used to pay off the overdraft that reduces monthly when payments reach it, Our main account is the one that most of the charges were applied to our agreed overdraft is £850 which i try v hard to stick to then they apply the monthly charges and bang the story continues charges for the next month for being overdrawn due to their charges !!!, its like 1 big cycle and now they are helping themselves to available funds to cover missed credit card payments its getting even harder to keen an eye on our balance,last month x2 direct debits were bounced due to them helping themselves so more charges coming our way now !!, I fully understand its our fault for missing the payments but we just cant afford to pay everyone we owe and its just getting worse, as the more chrges applied means less available funds !!0 -

Firstly, if there are charges on that credit card then reclaim them cos that should decrease that debt.
Do you have priority debt arrears(mortgage/rent, council tax, utilities)?0 -
There seem to be a lot of sucess stories on here so i can't understand why Halifax PLC are not paying me what i am owed.
In recent year i have had a lot of debt problems with unsecured debt of around £24k. For the past 6 month i have been paying in to an IVA. Recently i have been forced off work due to long term illness, and am currently living on incapcity benefit.
I am now in danger of loosing my IVA, i cannot keep up with household bills i have sent details of this to the halifax, along with my statement of benefit letter and all manner of supporting evidence and a budget sheet.
Halifax do not consider my case to be financial hardship, not only are they unwilling to pay me the £600 i am owed they also continue to take charges from my already reduced income.
What should i do?0 -
Hi I have been trying to get money back due to financial difficulties from bank charges from Abbey, its taken 2 months but finally they have refunded on two accounts, one single account of£415, and a joint account with £615. Although I am etternaly greatfull for there acnowledgement and responce they have used all of the funds to pay the overdraft charges that they put on and sent the money to moorcroft who now own the debt. where is the logic in this, I AM FUMING.. as this was meant to be payed to me or used to clear the debt in full and as yet I dont know what is happening... help!!0

I am in serious financial hardship and have had no written reply from nationwide(who i am claiming in excess of 12k) and no reply at all from barclays (who i am claiming about 3k from)i have serious arrears which would be cleared if i can get this money. I am owed money for work i have done and not been paid, i just got a hearing at court today after months of asking for the stay to be lifted because of my situation. nationwide showed up and the stay was held in place and barclays didnt even show up and their stay was held as well.
does anyone have any ideas, i am about to lose my home and i have nowhere to go and it will kill my wife and children. I am desperatly trying to get the money i am owed but these claims would sort me out.0 -

Which address did you use for Nationwide and Barclays?

You will need to register to access the Barclays I&E form but the Nationwide one should be self explanatory and off their site.0
