  • Tell him that 3 stamps and £10 cheque or postal order is all he needs plus your help to work out the charges ;). Otherwise he will lose probably 25% of any payout so about £200.00. Tell him whether he wants to pay you the £200.00 and you'll do it for him ;)

I have told him that but you know kids (well not quite a kid anymore but hey!) think they know best!

I am trying to claim mine right now with not much luck so maybe thats not really convincing him that DIY is the way to go!
whats the £10 cheque for anyway???

If the bank are not applying charges to the account today then I would agree with them since financial hardship is about current financial hardship caused by bank charges today. Is the account closed? Do you bank elsewhere and are incurring charges today?
Will have a look back later on this evening since I gotta go out again......

They closed my account when I first claimed in 2007 since I was having problems repaying my overdraft as I lost my husband that's when I opened my other account with halifax which I have had just a couple of charges with about £30.00 since.
  • got offered 170 all in for my 2 accounts , my reclaim was for over 4000+
    i rejected the offer

phoned today and the lass said there sending an offer out in the post

will it b the same offer?

They can touch the money since there is nothing stopping them for doing so unless it was for an assignment of debt at court, ie bankruptcy.
I would look at reclaiming the additional charges back. They might not pay back initially but if items continue to be bouned they might. It might be worth contacting priority debtors ie mortgage company(insurance claim if you have mortgage PPI) Council Tax( you should get a rebate) utilities(perhaps pay a lower amount) and consider cancelling non essential direct debits.

so is this no longer covered under section 187 of the Social Security Act 1992 for hardship?

They never were. By 'charges' they DO NOT MEAN BANK CHARGES. What is meant is things like attachment of earnings and charging orders.
Although there is some ambiguity, if you took a case to reclaim bank charges to court based on s187 of the Social Security Administration Act 1992 or s45 of the Tax Credits Act 2002 the court would almost certainly find against you.

No one is saying that the banks have the right to take money from benefits, only that you can't use the Social Security Administration Act 1992 or the Tax Credits Act 2002 to stop them.
  • hi. i was getting hammered for charges. now this is only for alliance and Leicester customers and now they are running a account called the choice account. Its a £5 a month account charge but they don't charge many fee's the only fee's they charge is £5 a day if you are over your limit. they don't charge payment fee's for direct debits. its alot better. as i don't mind paying £5 a month account fee & £5 a day if you go over.(for a max of 10 days a month) (£50 max charge) see the fee's here:

    http://www.alliance-leicester.co.uk/current-accounts/interest-rates-and-fees/choice-account.aspx

and yes i have been charged £5 a day for 10 days. but because i am unemployed "financial hardship" they just refund my fee's when i call them. I think a&l is the best bank!
  • Ok the Halifax might have told me where to go for my claim of about £350 but I have just rung HSBC and they are offering me £230 out of about £1700 and if I am still unemployed in 2 months to ring back and get some more. OK not a great amount but at least its a start.

Sound like they are trying to play you a bit. you really want to DEMAND it all. dont let them mess you about and play games with you.

Isn`t there a chance if I do that , that they might tell me where to go as well?

I am thinking in 2 months I could use Christmas as an excuse to get a larger amount.

She said they don`t normally give payments if you live with your parents but because mine are retired they would.

What do you think I should do?

Thanks for the fast response btw.
