Claiming charges back from Halifax around £3000 followed process and no luck with Halifax offered me £210.00 with 3 months free of charges. Today recd letter from FOS saying they agree with the Halifax offer until a result has been given on the case. I have a bailiffs order on goods in my house for council tax and two county court judgements.....don't really know what else I can do.0 -
This doesn't really make sense, debt collectors don't chase council tax, bailiffs do.
I assume this £4000 and £2200 is bank charges not council tax? Do you still have the income and expenditure form the bank sent you?
Didn't get sent an income expenditure form from the bank. They just sent a letter asking me to show I was in hardship. The £4000 is what I owe in arrears and £2200 is bank charges. Do you think I should just start again from the first letter detailing the charges to the bank?0 -
What's the difference between debt collectors and bailiffs? Thought they did the same thing?
Bailiffs
Bailiffs have the right to take away some of your possessions (but not anything that you can’t live / work without) so they can be sold to repay your creditor(s). They could be court officials, or employed by a private firm.
In most cases, bailiffs wouldn’t get involved unless the case had already been to court because you couldn’t come to an agreement with your creditor
If you owe money for magistrates’ court fines, the bailiffs will have the power to force entry into your home to take away possessions.
County Court bailiffs (for other debts), can’t take anything behind a locked door (in your home, garage, shed, etc.) on their first visit, unless you let them in or they find an unlocked door or window. Once they’ve been in, however, they will be able to force entry on any subsequent visits in connection with that debt.
Debt collectors
Although any contact from a debt collector should be treated as a serious matter, they are not bailiffs and it’s illegal for them to pretend that they are.
They’re not court officials and they don’t have the right to force entry.
Creditors can instruct debt collectors – or sell them your account – when you fail to pay back a debt as agreed.
If they’re employing the debt collector, they’ll be hoping that you and the debt collector will reach an agreement so there’s no need to get the court involved.
If they’ve sold the debt to the debt collector, your creditor will no longer be actively involved in the matter. The ‘problem’ of getting the money back will be the debt collector’s – and so will the money.
Debt collectors have to follow the same rules as the original creditor. Click here to see the ‘Debt collection guidance’ leaflet from the Office of Fair Trading (OFT).Didn't get sent an income expenditure form from the bank.0 -
I applied to reclaim my bank charges in 2007. I added interest to the charges owed and just as I was about to be paid the banks were agreeing to go to court. I am now in financial difficulty and since 2007 I now have custody of my children, a mortgage and constantly increasing my overdraft. If I apply for Financial hardship, do I send a letter with the interest charge that was originally sent in 2007. Or do I now calculate the interest from the first bank charge to the present day?
Thanks

When did you receive the FOS decision?
Has it given you 14 days to provide additional information if you disagree with the decision?0 -
