    Have you sent the second letter threatening court action on the credit cards?
    Where was the letter sent?

    On the bank account, the bank might argue that as your essential outgoings are not in arrears that they may not payout. Worth seeing though what they offer if they make one.

  • I need some advice.

    RBS have charged me over £1000 over the last 10 months. They have now shut down my account and have passed the account over to Apex Credit Management.
    The amount they are due is the amount they have charged, so technically there is nothing to chase.

    Now i did claim financial Hardship but have been turned down on two occasions, after sending them all the defaults i have been issued by the below vendors.
    I have no idea why and when I have repeatedly send correspondence as to why I get no response.

    Here is my current, horrific situation:--

    RBS loan £20,000 (Which I can’t pay and are being chased for)
    Cap 1 CC 3,000
    BOS CC £2,000

    At the moment when my wage goes in, it is gone with the above payments.

    If i goto the FOS about them declining me even though it is apparent that I am in financial difficulty do I have a case?

    I've been classed as been in financial difficulty (with priority debts ets.), and has this agreed with smile (part of co-op) but they still refuse to refund any charges/money. They're just stating they can give me money management advice, and to wait until the court case.
    Is there anthing else I can do?

  • I have claimed some CC charges back yes but they are through Cap 1 not RBS.
    RBS don't seem to budge.
  • I have just phoned the Ntionwide who have dismissed my hardship plea.... I live totally on DLA, Incap benefit and income support.

    They have informed me that i will have to pay £10.00 to get a full breakdown of charges on my account...is this blood from a stone? or are they wanting to appeal the next appeal until they get the result that THEY want?

    I am now having to contact the FOS as they probably wont evn acknowledge the template on this site.

    Um, yes, I am still using the account and still incurring charges occasionally. Feel a bit stupid admitting that but as we are nine hundred pounds overdrawn not sure how we could not use it - worried to leave and change anything in case they take us to court.

    RE. I have sent a second letter informing them that the case will now be sent to F Ombudsman for investigation. I guess that this really will be my next step.
