  • Hi i wrote to natwest 24/8/09 to request refund of charges total £3187.10 had a letter in post this morning 17/9/09 with an offer of £1871.00 seems quite a bit short of what i claimed.
    I didn't claim for any interset so i can't see why the amounts are so different.
    If i decline this offer whats the next step?
    Is it worth a phone call to see if they are prepared to up the offer as it says its a gesture of goodwill and a full and final settlement not sure how to proceed.
  • I have put in a claim as has my husband. Being on incapacity benefit I was sent a form which was filled in and sent back the same day. I am still awaiting a reply from the bank 3 1/2 weeks now ! I have however just been given a 'goodwill' payment of one bank charge back to my account as my payment in missed a payment out by 24 hours. This was the Nat West who I have been informed are cutting their bank charge to £ 5.00 yes £ 5.00 as of next month !!!! does this not say they know something ?

    My husband was told we are not in financial hardship... the wages go in on the last day of the month. By the 9th this month there was NOTHING left. !!! we are eating out of the freezer and when that is gone it is gone !

    This is simply due to a bad patch 6 months ago which was due to unforseen circumstances and bank charges were incurred at £ 400 for 3 months running.. there is no way back from that . The bank caused it and are now being taken to the ombudsman to have it sorted out NOW before we starve to death .

    I'm in Scotland, with Halifax Bank of Scotland. I got a letter back regarding bank charges of £70 I'm trying to reclaim. For the most part, it's legal jargon and a form about my income they want filled in.

    However, this is of specific note:
    We recommend you consult a non feee paying third party debt management company to assist you in completing the form. Such organisations will be able to support your completion of the common financial statement to help ensure we have all the right information to accurately assess your situation.

    Can anyone give advice as to how I should proceed next ?

    Don't reject the offer but accept and negotiate based on this criteria. You need to argue that a lifestyle event, ie unemployment, loss of hours lead to less income and therefore charges which impacted on priority debt arrears(mortgage.rent, council tax, utilities). If the amount clears the arrears then the offer is great since the rest remain "live" until the conclusion of the OFT test case(full and final settlement is ONLY for the hardship element of the claim). However, if it is lower then argue the way I have already stated and based on the bank charges since that lifestyle event. Accept and ask for more by all means because worst case scenario is that you get something rather than nothing.

    Do you have priority debt arrears(mortgage.rent, council tax, utilities)?
    You will need to argue in writing that the lifestyle issue caused the issues that created the arrears for them to make an offer. Are you in arrears and are you paying them off?

    I am not trying to be rude when I ask this question but is £70.00 the total amount of charges you have incurred since July 2001?

    The total amount is a fair bit more, though I can't recall exactly how much more, as it was years ago I'm really only trying to reclaim recent charges.

    Should I get records from the bank and try to reclaim everything they ever charged me ?

    absolutely 100%, in fact that is the first thing I would do if you are reclaiming under financial hardship. I had assumed you had already.

    Hi, I'm not sure if this is the right thread, has anyone had any success with coop bank please, or trying to get repayment from them. I need to start & was wondering how long they take etc. I'm living on incap benefit of 90 a week, my housing & council tax are paid, after utilities, insurances etc are paid I have around 15 a week for food, clothing etc. I think that I should qualify for financial hardship. I have tried finding recentish posts about the coop bank but can't.

    If you don't then they may well say that whilst you might be struggling that you are not in financial hardship.
