    After careful consideration of the information you have supplied I'm unable
    to refund charges on this occassion. You declared a defficit of £150.00
    per month; however you have no arrears and no debt, which does not seem to reflective of the situation of someone who has been in hardship since August 2007. In view of this we are unable to agree to refund charges.
    However we will review our decision if you provide us with further information relating circumstances. We realise that our answer will disappoint you however we trust that we have clarified our position.
    so I am going to send them every court threat direct debit return letter I have.
    and a letter explaining the FSA definition of hardship which I got from this site
    which is completely my situation also I have let the FSA have all my correspondence that i have done recently so they can decide.
    If the debts are with debt collectors then are you paying off the arrears or paying an amount that you can afford?
    Furthermore can you clarify just to be certain that you have Priority debt arrears(mortgage.rent(which you can lose your home), Council tax(which you can go to prison) and utilities(which could potentially lead you to being cut off))?
    Usually, it;s NON Priority debts that go to debt collection, ie Credit Cards, Catalogues, etc,etc/

    Yes absolutely you do. You can claim charges back to July 2001 on Bank Charges.

    if i got a full(ish) refund it would get me out of owing rent, tax , credit card and loan, which would help , all iv read on here is people asking for a refund and forgeting about it then get a payment, i cant forget money worries is with me 24.7 but everything happens for a reason , mibe they will pay me a huge compo payout for the stress lol
    I would claim the charges back on the credit card as well ;)

    Yes I have all the priority debt arrears council tax court arrears and utility
    arrears and credit card arrears my mortgage is on a suspended order but this is causing me to fall behing with everything else and know have just been made redundant. Are Nationwide particularly bad to claim from. I was thinking of sending all my court letters and missed payment letters and a new statement of means I did with National debtline or should i just wait know for the fsa ruling however long it will take.

    Send a new statement of means to Nationwide PLUS have you thought about claiming back the charges on the credit card since there is no hold on those claims ;) ?

    I will get on it right away many thanks.. So to clarify i need to ask the bank for a new list of total charges dating back to July 01 and at the same time inform them that I am in Financial Difficulties ?

    You need the amount of the charges to claim firstly, then follow this guide:

    Include an income and expenditure form(household)
    plus any notices of arrears when you get to the stage of sending the first letter,

    I am Just off the phone to HBOS and they asked a few questions about my circumstances and will email my details across to their complaints department informing them I am going down the Financial Hardship route. I have been told it could take up to 5 working days before they contact me. I will keep posting on here…..Its great knowing there are several people in the same boat and several more good souls willing to help
