I have today sent a letter requesting that my case be looked at again both under 'hardship' guidelines and the fact the original letter/claim was submitted before the original suspension of normality.
They'll also be getting a Debt Management Plan letter shortly so hopefully they will finally realise my financial situation!
I will update when I get a response...
I am just about to do the same thing today.
I put a claim in to HSBC in August 08 whilst the case was on hold. I however, am not totally sure that they received it as I got no response. I didn't realise to expect one until now due to it being on hold.
I have now put together a Financial Hardship Letter (including my original letter) to send out requesting that they review my case now.
Could you please advise me on whom/what address to send the letter to to guarantee that it is received as last time I send to my account branch?0 -
Hi all, I am more of a regular on the debt free wannabee board, but really need your help with something.
We submitted a request for consideration under the hardship waiver for bank charges reclaim to Bank of Scotland. The claim totals around £3100. Today we received a letter acknowledging that we are in hardship and offering £560:j.
Now, I have read a good bit of this thread and the more recent posts which say that no offer is a full and final settlement however the acceptance letter I need to sign reads as follows:
I/we confirm that I/we accept a total amount of £560 in settlement of my/our unarranged overdraft bank fees complaint.
Now, I'm not happy to accept this as F&F, and don't like the way this is worded. I am happy to accept this as their final offer under the hardship waiver, and receive the balance pending the outcome of the test case. Is there a good template letter available which I could use to respond? Thanks for your input in advance!LBM 30/6/9 Unsecured debts [STRIKE]£25,323.48[/STRIKE] £0 :T Debt free

Write one yourself with their reference number on, ie I accept £560.00 as an interim payment of my bank charges claim and reserve the right to reclaim any outstanding amount at the conclusion of the OFT test case issues.0 -

That is unfortunately FSA compliant so what you need to argue is really how things have worsened since you were made redundant and how the charges have contributed to it. If you can;t then the FOS will uphold the decision made.0 -
