I logged a claim with Nationwide based on the following:
I went on holiday developed DVT and stayed in hospital when away AND on return to UK. Needed 1 month off work - got sacked in Dec 'for poor performance' (ill health!!!).
DWP didnt pay any money to me for 3 months so NO INCOME except 1 week wages, yet lovely Nationwide - decided i wasnt a case for financial hardship?!?!
what do you have to do, Die?
£300 overdrawn - mostly all that was fees for non-paying direct debits, as i had zero funds coming in from anywhere to live on!
absolutely a disgrace. needless to say account not been used since!0 -
hi just wondered how long i have to wait for halifax to reply to my letter and expentiture form i filled in, i sent it on 12th july, then sent them another letter regarding another bailiff letter i had recieved. I have got a water bill now to send to them that proves even more of financial hardship as cant afford to pay that. I have got the bailiff coming round on 31st to see if i can pay 1400.00 which i cant please help!!!!0

I have a couple of questions:
1. Is there one set method of establishing hardship that is used by all the banks?
I notice from earlier in this thread people have mentioned information their bank wanting information from them that differs or is in excess of the information my bank (RBoS) wanted from me. I tried to claim citing hardship last year & they wanted my income and outgoings, as well as my partners income (but not outgoings). I refused to give them my partners information because they only wanted his income & not his outgoings.
2. My bank have told me that I must establish hardship of the "household" in order to get my charges... however, the bank were not interested in the "household" financies when they levied the charges. Is this correct? In order to get charges that were applied to me as an individual I must demonstrate that my 'household' is in hardship?
2. Is it worth taking my claim to the ombudsman?
I have just finished studying for a degree. During the 3 yr period I took out a 1600 overdraft and was told by the bank that I would get a 0% interest loan to pay for the overdraft when I graduate. The bank have rejected me for a 0% loan, they've looked at my income/outgoings and state that I need another £300 per month to function (my partner actually pays 50% of the bills but they will not take his income into account in this instance). I have written to the bank to say that since by their own reckoning I need £300 to survive will they now consider me a hardship case and was advised no. Will I get more luck via the ombudsman?

Hi everyone I am new and looking for some advice.
I am considering applying for hardship as i "repeatedly exceed your credit card or overdraft limit without agreement". I have got my charges summary the sum comes to £3500 over the last few years.
I am concened that I don't meet the hardship criteria. I am still employed (touch wood) and cover all of outgoings, some items have reached debt collection letter stage but they have all been sorted. The problem is that about 6 months ago our boiler died and have have been without any kind of heating ever since. The whole thing needs replacing (£££K?). Since it died we have tried to save up but a combination of bills, living and the every charge monthly charges of about £100 have meant that little to nothing has been saved. I am in position to get a loan and my ccards are all maxed.
I would be grateful for any thoughts...thank you..0 -

I put my case through mcol last year which the bank stayed..
I have now gone into Financial hardship which lloyds have agreed i am but are unwilling to pay me anything...
I just need to know what i can do now, as I have already claimed through the small claims, and am unable to go through the fos??0 -
Sent everything off to Nationwide requesting charge details for my active current account and closed current account. They have only sent me the charge details for my active current account. I thought you could claim for closed accountsDEBT FREE AND LOVING LIFE0

Hi,
I had an account with Lloyds TSB, whom I wrote to trying to claim up to about £500 in bank charges over the past 4 years, they wrote back saying I would have to wait till the end of the case despite suffering from financial hardship.
I was so frustrated by Lloyds that I closed my account with them, lest be charged by more of their fees.
Am I still able to claim back these amounts when the battle is settled in the courts?

Do you have priority debt arrears(mortgage.rent, council tax, utilities)?

Have you had any correspondence from them whatsoever and if you have a phone number for them, ring them ASAP.0 -

Financial Hardship is based on household income.

Where the firm does not have sufficient evidence to assess whether or not the complainant is in fact in financial difficulty, the firm will seek such further relevant information as is reasonably required to make that assessment. In the event that the firm reasonably requires relevant information to be provided by the complainant and the complainant does not provide the requested information within a reasonable period of time, the firm shall not be obliged to treat such a complainant as being in financial difficulty."
If you don't or won't send the information on financial hardship the bank have every right not to proceed your case.0
