Do you have priority debt arrears(mortgage/rent,council tax, utilities)?

No it is for a loan & a CC.

It is unlikely they will agree with financial hardship but get your letter in so they will acknowledge your claim HOWEVER, there has gotta be credit card charges? They are NOT on hold so you might want to start on the credit card charges as well. Loan with payment protection insurance(PPI)? You might have a claim on that as well ;)

    Thanks for that.
I will send the letter off & join the queue anyway then.

Do I send it on the hardship template still??

I do have a couple of loans with PPI but they were taken out online so I am not sure I have a case??

You might as well ask the questions with regards to hardship.
Check the policies for PPI and whether at the time you took them out you were eligible.

I have just noticed that although I have managed to get charges refunded from Barclays on all 3 of our accounts...they have paid them from 2003 - August 2008 (when the new opt out charges started). I sent them the template letter downloaded from this site, and it said please send details of all chrgs from 27th July 2001. Checking my paperwork, the list of charges for all accounts are only from 2003. I know I am probably going to get slated on here for asking this,(as i have already got some money back) but can I go back to them and say thanks for the money, but I still want to know how much they took in charges from july 2001 - 2003, and try to claim these too?

Also my sister has asked me to try to claim her charges from Abbey for her, which I am happy to do, but can anyone advise if successfull how they would refund the money to her....she is in a debt plan with Chiltern, she sends them 200 per month and they share this between all her credit card and loan debts.

    Thanks

Yep, but they would not refund them under Financial hardship.

She can reclaim but she might want to start reclaiming her credit card charges to reduce to total amount outstanding through Chiltern.
And tell her to register here ;)

I sent all my docs off to First Direct about 10 days ago as I am claiming £2600 under financial hardship and received a letter today agreeing that They could see I was struggling and whilst they haven't admitted liability or offered to pay back the charges they have offered me £108 to help me out while they wait for the high court judgement. If they do pay out they will take £108 off any final settlement.
I sent them copies of my Payplan dmp, 6 months bank statements and p60's from my f/t and p/t jobs. Rather than just fill in there form I thought if I send everything then there will be no messing about and they can see quite clearly the troubles I am having and the work I am putting in to try to stay afloat. I can only hope that in the coming months that the case goes in my favour.

Showed her the site today, and she was so impressed she handed over £50 for me to get postal orders tomorrow, and gave all the credit card acc numbers to me so that I can get all the first letters off tomorrow....I told her that I thought if she got credit card charges back they would go to the people dealing with her debts and thus reduce what she owes....You are a godsend...and I am learning from you every day I log on here.... I thought Barclays was bad in charges...but the one statement she showed me from Abbey Feb 06 - March 06 they had charged her £405 in bounce charges.....I imagine I will be spending hours on here putting her charges in to the bank charges calculator.... she lost her job in 2006 hence the debts.:A

    Hi,

I had an account with Lloyds TSB, whom I wrote to trying to claim up to about £500 in bank charges over the past 4 years, they wrote back saying I would have to wait till the end of the case despite suffering from financial hardship.
I was so frustrated by Lloyds that I closed my account with them, lest be charged by more of their fees.
Am I still able to claim back these amounts when the battle is settled in the courts?

    Many thanks,

    Anthony
