  • Hi, I've had a reclaim in with Natwest for some time now. They have actually agreed that I am in financial hardship (they couldn't really ignore the fact that I'm now on a financial management plan and clearing my debts with smaller regular monthly payments).

    They've also agreed to pay me MORE than I asked for. Seems unprecedented. I asked them to pay by cheque, as I don't use the Natwest account anymore.

    They have replied that as my account with them is still open, they will only refund into my account as this is their policy. My fear is that since I have a loan with them on the repayment plan, that they will pay the money in and immediately grab it back. If they did that and called it a full and final settlement for the loan I would be happy with that, but with a currently condemned boiler I could really do with the cash.

    Do I really have any options? Are they quite within their rights to say it has to be paid into the account? What would happen if I closed the account, could I force their hand that way?

    If anyone has any advice on this before I decide whether to accept their offer I would very much appreciate it.

    i would call them if I had a number to advise you on(which is annoying that I don't).

    hi i have been trying to claim with lloyds since last year, i put it through mcol too which the bank stayed.. I have now been trying the hardship route which lloyds have agreed i am and have put me on a payment plan to pay back my overdraft, but have said they will not pay me anything back till the end of the case...

    Im just wondering what i can do now as you cant claim through fos if you have already taken it to court??

    any help would be much appreciated :)
  • I was in the process of reclaiming bank charges of 6,000 from Lloyds TSB - This was a joint account with my ex-husband at the time.he took over the account when we split and we remained ammicable. We pursued the claim together - I wrote letters he received the replies as the bank said because I was no longer the account holder they could not respond to me.

    My ex-husband recently died. His accounts are now closed. How does this affect the claim - had it been settled in the courts before this he would have been paid. Does this money if repaid go to his estate for our children? or will it never be paid out?

    Had an offer from Halifax today (8 weeks and 1 day since I started my claim) for £140.00, my claim is for £4,351.00.

    The offer is for 29th June 2009 - 30th July 2009 which I do not understand as I claimed up to the date 3rd June 2009.

    I called Halifax to ask them to explain their decision and they agreed I was in financial hardship but that's all they are going to offer at present (it's an interim payment).

    How can they justify these dates for the offer when the claim is up to 3rd June 2009?!?

    I have sent all relevent documentation to the FOS as of today and can only hope they can sort it out.

    Getting further and further in to debt :mad:

    did the same to me, they owe me approx £3000 and paid £413 into my account yeterday..
    Let me know how you get on with the FOS as i may have to give it a go myself :)

    Are you having a nice day cos mine is rubbish because of all the debts that i have meaning my priority debts are in arrears?

    To be totally honest you are asking them on the progress of your claim. If you want to add the rest of the stuff in there then feel free ;)

    Do you have priority debt arrears(mortgage/rent, council tax, utilities)?
    Are any of the arrears being paid off?
    Do you still use the account?
    I have not worked for NatWest Bank since February 2009

    I have council tax arrears which bailiffs have contacted me for, I am in arrears for gas electricity and water which are about to go to court. All of these I have sent proof to the Halifax so they are aware.

    None of these are being paid off as I do not have anything to pay them with.

    This is my one and only account

    Is there no income going into the account?
