    Is there no income going into the account?

    I am on state benefits since I lost my job last year so apart from the benefits no other income. I am a single parent with no maintenance being paid towards my son either.

    I'm a cancer sufferer and my wife is disabled. We're trying to reclaim £100 from Yorkshire Bank, but so far they've only acknowledged my hardship letter and told me it could take 8 weeks to investigate.Anyone else had any success with YB?

    Where are your benefits being paid into, this account ?

    If it is the bank then change it, get them paid into a post office account if you can, or another basic account with a different bank.

    Are you having your current years council tax paid by council tax benefit ? Are you getting all the other benefits you are entitled to and have you been in contact with the CSA ? I don't know the circumstances, if you're anything like me then they;re complicated lol.

    I would have thought the hardship should go back to when you lost your job/became single whichever was later. Without seeing your income expenditure and knowing a bit ore about your circumstances its really hard to say, but I would carry on fighting them and yes definately take the case to FOS.

    Gas, Electric and Water, don't just stick head in sand and ignore them - you can have arrears amounts attached to benefits. Same with council tax. You have to be a can't pay and talk to them, rather than a won't pay by ignoring them. Council Tax most important so call them and talk to them about your situation and see what your options are. I assume if its going to bailiffs you already have a liability order - if so did you complete and return the IE form following that ?

    If you have no priority debt arrears(mortgage/rent, council tax, utilities) they may not consider you to be in financial hardship. However, you might want to argue the circumstances of your specific case to them for a gesture of good will refund

    OH spoke to Yorkshire Bank today going over income/expenditure.
    they said they will be paying us a part payment of our 2k charges.
    I think its about 700squid
    they said we would receive payment through the account and a letter will be in the post with information on this also the balance will be issued when they test case results are finalised.
    I will post up info when I receive the letter.

    I have had long ongoing issue with Halifax since the death of my late husband in Jan 2008. We had a joint account (overdrawn) which they then put into my sole name. At a so called bereavement interview at the bank , they only wanted to know if I was going to have any money to invest following my husband's death. I enlisted the help of the Citizens Advice Bureaux who took my case and wrote on no end of occasions to the Halifax. Also they sent letters via fax, all to which the Halifax stated they had not recieved. They continued to delay and accrue interest for over a year despite my situation. Also I had to make payments from my other personal account, again the Halifax making me more overdrawn on that account.
    I have sent all info to the FOS re financial hardship and the very inappropriate way I was treated by said bank.
    The Halifax say they acted in a sympathetic and positive manner to my case???? HOW?
    Awaiting findings.

    To be totally honest you are asking them on the progress of your claim. If you want to add the rest of the stuff in there then feel free ;)

    how come the other banks seem to be paying out quite easily and the halifax dont!!!!

  • i have applyed to norwich and peterborough under the financial hardship rule as i was made bankrupt last year, i filled out their income and outgoings form and they have said i have plenty of income to cover the basic living cost although when i filled out the form i was spending more than i earned, what is the next step. where do i stand??

    As a self employed person, working on projects, my income varies considerably from month to month and prior to 2007, I had incurred £7,011.45 excessive bank charges which I decided to reclaim from the Abbey. I used the template letters provided by MSE but immediately fell into the OFT Test case so no progress. In May 2009, I found myself without work so applied under the hardship provision and have just received £431.45 which has put my account back within its limits. It was so because of bank charges!

    The letter states that my claim still remains on hold pending the outcome of the OFT test case.

    I feel this is a partial win so was worth doing BUT banks are getting around the Hardship rules. :confused:

    Hi, I have tried to find the answer to my question in this thread butseeing though there are close to 1500 posts, I couldn't lol.

    Just about to take the plunge and claim back bank charges. After £200 of charges in the last 6 weeks!!!

    Anyways, someone mentioned something about financial hardship etc and not having to wait in the queue. Kinda like a queue jump pass. I have today registered for a Debt Management Plan. Would this be classed as financial hardship? In essence I will be better off with money with having a lower payment to make each month but otherwise, I am still on a debt scheme so I presum I would be classed as 'financial hardship'
