Firstly, you are here so we can help you and the next thing I would do is have a look at the debt free wannabe section of the site and have a good read because there are a lot of people who are in similar circumstances to you. I think you may have a good case.
Is the bailiff letter new or has a copy been sent to Halifax?
yes the bailiif letter is a new addition thats 2 in last 4 weeks. i sent a copy to halifax day after posting my expenditure form but they had no record of it but it was sent recorded. so said will give it a couple of days then will ring them again
  • Just been agreed by Natwest that they would refund my £86.00 in bank charges due to fianancial hardship providing that i return my switch cards in exchange for solo cards. Or they wont give me my money back.

I am quite happy to do this as i care more about my £86.00 than i do about my switch card but i just feel this is a real slap in the face from Natwest its like they have resorted to bullying actions and childish tactics ...its like you can have your money back but you cant keep your card . And as a customer who has a pretty good history with them and have done a lot of business with them in the past i am pretty diappointed.

I probably will now change my bank account to another provider after all who wants to stay with a bank who have a stinking attitude like this.

I think it is a reasonable action to take if you have had cheques returned for them to take. If you read the back of your card(I just read mine) it says that the card remains the property of the bank. How much were you reclaiming under financial hardship?

  • Have been struggling with debts for the last 12 months, attempted to lower credit card payments by myself in March, gave up & went with a debt management company a few weeks ago. Today I totted up my bank charges with Natwest & since 2003 and it comes to £4300. Needless to say there will be a letter winging it's way to them on monday, along with letters to my credit card companies about their charges! Cannot belive it! Hope to have some good news in the near future-will keep you posted!
  • I only claimed £86.00 back and i didint write cheques this was all as a result of me miss calculating and going into overdraft by £3.00 due to a direct debit. In my whole 7 and a half year history with the bank these are the only charges i have received .

But my point was that the bank are using bullying techniques and child play in order to stop customers claiming .... would they be asking me for my card back if i was not claiming charges ...no ....would they ask me for my card back if i now said id rather keep my card than take the £86.00 ....no.

This could have been sorted from the start but they point blank refuse to give you a refund when you call up.My credit rating is good and even though we are struggling we are up to date with ALL of our creditors so they are now going to lose a good customer for there own stupidity im off to First Direct at least ill get £100 out of it ,before all this i was loyal to Natwest but now i have no loyalty at all.

Incidentally i did also used to work for Natwest so i can see things from both sides of the coin.
  • The payment plan on the debts negates it really from hardship. I would concentrate on the account which you use the most and have had council tax direct debits returned from,

But we are in arrears of over £500 due to hardship, they were all for putting pre payment meters in.

The council tax wasn't returned, we called them and they said to cancel the DD and they would be in touch with an updated plan. My income has dropped significantly recently.

They're not stopping you from claiming but if you are in financial hardship then having the card is totally irrelevant. When you are struggling, principals can go out the window and the changing of the card is not a permanent issue. In fact I would go further and ask how did they payout if you have only had £86 in charges? They are certainly going soft in my opinion,

Well you gain a £100 as well so it has worked out for you.
Incidentally i did also used to work for Natwest so i can see things from both sides of the coin.

If you see it from both sides of the coin I don't see why you do not see it as reasonable to downgrade the card so that you do not have as a minimum £2500 worth of cheques that can be guaranteed to pay out. Was it branch based?

Firstly you can go back to 27th July 2001 on the charges so you have more work to do on the charges ;)
You beat me to credit card charges so you seem to be well versed.

Look I am giving my opinion based on the facts I see in front of me. It doesn't mean I am right but it does mean that you are not given "false hope" that you are in hardship.
Hope that makes sense. I think they have room to say no but that doesn't mean that they will say no.

Hi guys im new on here and wondered if you can help me.

ive decided to claim back all my bank charges as im sick of always being charged by my bank who is HSBC for going overdrawn however im wondering if i should claim through the financial hardship option or not.

im a university student and dont have a job. i asked HSBC if i could get a student account as the overdraft would really help me however they said i couldnt because of my credit rating.

this means that it has been a real struggle trying to keep with my direct debits as i have rent to pay as im not living at home etc. and thus resulting in me always getting these bank charges

do you think i could claim under the financial hardship option as i never saw anything on here about being a student etc

thanks for any advice i really appreciate it guys
