    Hi, i have 3 accounts with Lloyds TSB which have charges dating back to 2002 and which amount to 12k between them. I went down the financial hardship route as i have a debt management plan with the C.C.C.S. which i had to take out in March 2006 as i did not have enough money to pay the bills each month (we are still on this plan now).

    I sent my claim letters for each account to Lloyds on the 8th July 09. Then i received some letters back from them dated 10th July 09 (which i was impressed with) they state that they have received my complaint and are very sorry to hear i have some concerns, then go on to say they will get back to me in 4 weeks.

    Just wanted to know if u thought this was acceptable, as in the template letter i sent to them it stated that i would like an answer within 14 days, should i just accept it will take 4 weeks or should i be on thier case to get back to me sooner?

    I would probably agree with widelats on this one.
    It is an awful situation to be in and whilst I sympathise with you I think it would be unlikely that the bank will refund the charges under financial hardship.
    I would still ask the question but do not expect a positive response.

    They have 8 weeks before you can even go to the FOS. The letters are based on going to court who will stay the claim.
    Do you have priority debt arrears(mortgage/rent, council tax, utilities)?
    Are those arrears being paid back?

  • The letter seems ok apart from there being no priority debt arrears. Is there any charges on the credit card you could reclaim or PPI on the loan?

    The only charges I am getting is on my over draft. There was about £235 worth last month and £105 this month. I get paid on Wednesday so trying to not do anything with my account. I am going to speak to halifax to start claiming the charges with them next. Just want to get Barclays sorted as priority. As what they owe me will clear my credit card or certianly a large amount, as they owe me around £2,500 with interest.

    I don't have arrears at the moment but am not able to pay my mortgage on the date i'm supposed to, normally 2 weeks late.

  • Hi, I'm new to this site as well as claiming bank charges, so I'll probably ask a few stupid questions, please bear with me.

    The main thing I want to know is about bank accounts that charge a monthly fee. I'm with Lloyds TSB and about a year ago they convinced me to go for their Platinum account which was on free trial for 3 months, after which they started charging 25£ a month for the priviledge. I wanted to come out of it and go for a standard account, but they convinced me to stay on... and I haven't quite done anything about it since then.
    Looking at my statements consecutive unplanned overdraft charges ect, I seem to be qualified to apply under financial hardship criteria, but I'm not sure if the type of account that I have would have an effect on their decision.... DOES ANYONE HAVE ANY EXPERIENCE OF THIS?

    Any advise would be much appreciated. Many thanks. :rolleyes:

    You need to clarify the type of account you have and get rid of the benefits of it to a standard account on the basis that the amount going out is reducing your ability to pay your priority debts(mortgage/rent, council tax, utilities). You do have arrears on them right?

    When was the first income and expenditure form sent?

    Hi,

    I sent the form in March 2009 and I received a refund of charges from October 2008 up to May 2009, a total of £250.
    I did not receive any communication from them, the charges were just refunded into my account.
    I have heard nothing since then but they have again levied charges totalling £75 in June for paid items, I was under the impression that all charges would be stopped under financial hardship rules.

    They have not responded to my letters and I am at my wits' end,I also have another complaint with them going back to March 2008!

    Thanks widelats & natweststaffmember for your responses.

    She is and has been for sometime significantly in her £2K overdraft - all the time (i.e. when her pension gets paid in it does not take her out of her overdraft) - If she were to make a claim what is the likelihood of them canceling her overdraft and making her pay back the money?

    Also, if she makes a claim using the financial hardship route and they kick it out can she make a claim any other way and if so when can she do this?

    And lastly, if she instigates the claim and passes away whilst awaiting a decision what happens then? If there is any money owed her does it go to her estate?
