  • Can I clarify whether you are claiming BANK CHARGES or CREDIT CARD CHARGES?

    Bank charges
If it is BANK CHARGES can I ask why you want to go to the FOS?

I don't know, thats why I've asked what I should do next. The letter from hbos says to contact the FOS.

Hi guys im new on here and wondered if you can help me.

ive decided to claim back all my bank charges as im sick of always being charged by my bank who is HSBC for going overdrawn however im wondering if i should claim through the financial hardship option or not.

im a university student and dont have a job. i asked HSBC if i could get a student account as the overdraft would really help me however they said i couldnt because of my credit rating.

this means that it has been a real struggle trying to keep with my direct debits as i have rent to pay as im not living at home etc. and thus resulting in me always getting these bank charges

do you think i could claim under the financial hardship option as i never saw anything on here about being a student etc

thanks for any advice i really appreciate it guys

Yeah, as long as you can prove that your having financial difficulty/on benefits then hsbc should look into for you.
If you've already got your statements send off the letter with a copy of your financial statement and copy of your income

    good luck

Apologies had to re read back to see what the situation was. Ok, the £266 is not a full and final settlement but is an interim payment.

Do you have priority debt arrears(mortgage/rent, council tax, utilities)?
Does the £266 clear those plus any overdraft that you may have?

Are you behind on your rent?

Have you also spoken to your university with regards to hardship funds as well?

At the moment I stay with my parents so although I pay then rent its not in arrears and no council tax or utilities. I have outstanding debt and will be moving to halls of accomdation in september.
The £266 is about a quarter of my overdraft.

That is a pretty good payout under the circumstances.I doubt the FOS would increase that amount.

Hi, I wonder if someone can help.
My mum has been charged on awful lot in overdraft fees since 2001 and am looking to assist her in reclaiming.

Although her incoming pension just about covers her outgoings its quite tight. This leaves her with nothing each month to spend! Literally all she is doing is paying her bills.

Unfortunately she has just been diagonosed with terminal cancer and I was wondering whether she could use the financial hardship route to progress her application? Really, what would be good for her is if she has some pennies to enable her to do a few things before the inevitable happens. Does any of this seem a viable option?

    Thanks in advance
    Mat
  • I am new on here so please bear with me. I having been waiting for my charges to be refunded for 2 years. But I am not in a finacial situation which I can not get out of. I have been refused 2 loans 2 consildate my credit card and exsisting loan. I am still currently incurring charges with halifax, bacause I go over my overdraft which is happening more often.

I have written the following letter does its sound OK?
FSA Waiver Directions: Financial Hardship Claim

The purpose of this letter is to request your kind assistance in helping me get through a period of temporary financial hardship. I wrote to you on the 26th June 2007 concerning a request for a refund in charges, which occurred.

At this time I bought a property, which I proceeded to renovate, hoping that the refund in charges would be received to help me move forward with my plans on my home. I requested a loan to help on a temporary basis as the house was unliveable at the time. Hoping that my refund in charges in charges would be received to help with the renovation. I understand there is currently a hold on all these requests, but I am sadly now in a position where I am up to my limit on my credit card, I do not want to take out a further loan to cover this period. Also due to the fact that I currently have low interest on my loan, and if I was to consolidate it the APR would be higher than what I am paying now. I would also be in the same position now, with no access funds.

I am just about meeting all my payments on my car, mortgage, utility bills and credit card. But each month I go further in to my current over draft and now on more than one occasion I have incurred further charges with my current bank. Which means I go further and further away from getting straight. My free money is no more, and I am now just ensuring that fuel goes into my car for work.

I am now worry continually about putting food on the table and covering my current debts. Which is causing my eczema to flare up.

I am now borrowing money of my parents to cover my car maintenance and know that I will end up borrowing more to get my car tax done at the end of August. Also to cover future bills.

I very much appreciate your kind consideration in this matter and look forward to hearing from you shortly.

We are getting in a month's time and I am now panicing like mad, all I want to do is get my finanaces straight.

    Thanks in advance

If someone has cancer there is a awful lot of things they need, i think the hardship waiver only covers your debts like water, electric, rent etc, i do not know if it covers items that are essential like maybe wheel chairs and medical stuff, it could be worth trying to claim on that basis though. Although i recently got all my debts sorted by the citizens advice into payment plans vastly reduced, i am still going to try claim hardship from the bank on the basis of things i need.
    Owed out = lots.

The letter seems ok apart from there being no priority debt arrears. Is there any charges on the credit card you could reclaim or PPI on the loan?
