    Fill in the form and give them the information. They have every right to ask for additional information with regards to financial hardship. If you see my signature, there is a link to the FSA Waiver and Annex 2 point 6 states that if you do not provide sufficient information for them to assess you then they can decline your financial hardship element of your claim.


    The point I am making is that I had already sent them all the information they asked for and had 7 months charges refunded.

    So why are they asking for this info again?

    Also they have not responded to several letters I sent them and I feel it is just delaying tactics on their part, they have not replied to the letter I sent telling them that I'd already completed Income/Expenditure Form either. I don't mind supplying the information, I just don't know why they need it twice.

    I think I misread your initial post(apologies).
    When was the first income and expenditure form sent?

    Following on from my much earlier post. Abbey automatically credited my account with about 20% of what I claimed. I wrote back asking where they got that figure from and provided further evidence of more recent financial hardship etc. I stated they should reply within 14 days.

    I received an automated letter as if I had put in a new claim, it read that they would look at my complaint and get back in due course, but all claims were on hold. they did not address at all any of the details in my letter or what they have done so far.

    It is now 30 days, what should I do at this point?

    They have 56 days in total so it might be worth calling them and asking the question albeit I would do that tomorrow morning or Monday as I am sure that the office that deals with hardship claims would be shut.
    Did you accept the 20% and did that clear some of the priority debts(mortgage/rent, council tax, utilities)?
    Have you incurred more charges?

    Barclays however have written to me today to tell me that I cant have a refund until the FSA and OFT sort out their arrangements, but this is waivered for the hardship claims isn't it?

    There is some other guff saying that if I claim through the County court, then they will apply for a stay on my action until the test case. Is this basically a stalling letter?

    The County court stuff is factual information.

    Do you have priority debt arrears(mortgage/rent, council tax, utilities)?

  • Barclays haven't asked me for any information regarding my income / expenditure!

    Yes, we are in arrears with our council tax and have taken two months since we paid as we couldnt afford it. They are now asking for £150 (£60 more than we usually pay) by 5th Aug.

    We owe a significant amount to the electricity company and are on a payment plan with them to cover usage and a small amount of the owed amount.

    I sent a letter to the Halifax some time last year and got the standard "all charge claims are on hold until the test case is completed etc.."

    I have now sent the financial hardship letter to the Halifax due to council tax arrears, debt collecting letter as the Halifax referred my account to them and utility bill arrears that are with debt collectors.

    What do you think my outcome would be? I have spoken to Halifax Money Management team previously and they advised that my expenditure was more than my income.

    Do you think they would pay out to me? They can hardly argue the fact that financial hardship doesn't exist surely?
