    Has the overdraft limit changed whatsoever in the entirety of your claim with them?

    The overdraft limit has not changed whatsoever inthe entirety of my claim with them. I put my in the cash point to see if the £1995 had been refunded and it was ate up - I now have no card and therefore am unable to use the account.

    In that case write to the FOS and tell them that your overdraft has remained unchanged throughout the entirety of the time the claim was there. Explain that the cashcard has now been swallowed and that the bank appears to have stopped you using the account whatsoever even though you have no other card on the account. They have not suspended charges and the amount they have repaid has merely taken the account under the limit of the overdraft and charges are due out taking it back over the account. Whilst the refund is encouraging in that the indebtedness to the bank is no longer an issue until they take their charges again this month, it isn't helping you pay your priority debt arrears.
    From what I have read there is no payment plans in place and the bank are effectively swallowing all your income, right?
    How are you surviving under these circumstances or is it that money is going in and the charges stream out of the account?

  • hang on, downgrade the account to one where you do not pay a fee for it.

    Thanks for coming back to me. They upgraded the account when I put my claim in as the guy said I would only have one charge per month as this £12.50 allowed for this - this has not been the case! Nothing is suspended on the account - interest is being taken out every month and charges added on.

    I am trying to open a basic bank account to try and get my salary paid into as as soon as it reaches the Halifax I end up with no money. I am being harrassed by the bank and other creditors for repayment of monies I don't have.

    I believe the bank have not acted correctly or fairly and I also don't believe that ombudsman have been helpful

    Make the ombudsman aware of this £12.50 issue as well because helping customers in financial hardship by getting them to take out an account that adds to that hardship is bad customer service.

    Hi all- I have/had a £2000 approved overdraft with the hsbc bank a few months ago i started experiencing financial difficulty due to the credit crunch. i started going over my agreed o/d every month by about £600. I would try my best to get back inside o/d but with the extortionate charges levied it became more difficult every month. I started getting plagued by hsbc's infamous mumbai call centre threatening to return payments. Eventually they started to cancel any d/d's which went over my o/d. I started paying these d/d's on my credit card. I also started to reduce my d/d's by about £300. I then applied to hsbc for a list of bank charges dating back to 2006. I posted a letter on 8/7/09 recorded delivery claiming £4000 bank charges with interest. On the 13/7/09 i received a letter dated 9/7/09 from hsbc collections revoking my approved o/d as i was £150 over my limit. They also cancelled all my remaining d/d's and demanded my debit cards back or they would send round a collections agent. In the same post they also sent me a letter containing over £300 in charges. All my payments tax credits , wages ect are paid into this account. so now i am in the situation of having all my income being paid into an account i have no access to no d/d's being paid and to cap it all they are charging me £300p/m for the privilige. I think its a bit of a coincidence that they finacially murdered me the same day they received my bank charges claim. any one in the same boat or has any advice . gaz

    It is a coincidence but I would get another account opened up ASAP.

    Do you have priority debt arrears(mortgage/rent, council tax, utilities)?
    Are any of the Direct Debits for them being paid on your credit card?
    Which address did you use and was the letter sent recorded delivery?

    Thanks for the quick reply! every d/d mortgage , utilities, loans, and credit card paymentshave been stopped. so i cannot use my credit card to pay anything even if i wanted to. i sent it to central operations in leeds. i have logged a complaint with hsbc complaints. gaz

    Was the letter with regards to hardship sent recorded delivery to leeds, right?
    Have you managed to get another account opened yet?
