The Data Controller is for the Subject Access Request. I would say you can claim for further back.
Hmmm, do you have any credit card charges?
Any PPI with the loans?
Personally without priority debt arrears I think they may decline it however, the CC charges and PPI may be an easier route to go down to reduce the overall non priority debts.0 -
Hi their final response is that they have dealt with my complaint correctly in that they discussed my financial position with me & made a goodwill gesture of refunding me a £30 unpaid item charge.I have poseted all the information to the FOS including my budget.:mad:natweststaffmember wrote: »Have they given the reasoning behind their decision? Is it worth sending the initial letter again, or should i assume it has made its wayand send the LBA. If i need to resend where should i send it?
I do have cc charges however obviously nowhere near as much as the bank charges claim. I don't have any PPI.
If i am unsuccessful will i need to try again once the outcome of the court case is determined?0 -

Was that it? When you go to the FOS you need to use their argument which should be a final response letter to argue your case. That doesn't appear to me to be a final response letter because it doesn't give the reasoning behind the decision.0 -

ok, I don;t have an address for HSBC on that one but I do have a phone number..not sure if that is any good but here it is 0845 600 6423. Might be worth a phonecall and ask them where to send the letter(apologies but the only other address I have is their head office one).Is it worth sending the initial letter again, or should i assume it has made its wayand send the LBA. Write a letter in response and ask them for a final response. Make them aware you would like to know why they believed £30 was sufficient under financial hardship when you have priority debt arrears of x amount and income doesn't cover expenditure by x amount.Hi ,so do you think I still have a case?How long does it take for the FOS to respond?Thanks again for your brilliant advice!!0 -

£5686 was the original amount up until the end of April 2009 - further charges of £1200 have been added as the account is overdrawn. The overdraft is £2000 and has always been in place - this has not changed since the claim. The balance on the account is -£3320.49 :mad: with the £1995 goodwill gesture already being paid in. They just keep adding more charges, interest and £12.50 per month for the account. How do I stop them from adding further charges and reclaiming back some more of these charges.
I am currently trying to set up repayment plans with the debts.0 -
