Bankruptcy Credit Reference File Clean Up - Discussion

  • I have just started the lengthy process of clearing up my credit file since my discharge last year.

    My main problem is mortgages - I had over 100 of them (I was a landlord) and while a lot are now showing as 'settled' because the properties were repossessed and sold, I have about 20 houses which are being controlled by a receiver as he has decided not to sell yet in the current market.

    Obviously this could continue for some years while he rents them out. However they are all showing as in default because the rent is not covering the mortgage and just increasing the debt.

    My question therefore is that can I request for these accounts to be shown as settled/satisfied or similar?

  • Hi, I have been discharged from my bankruptcy, and have for the last few months been contacting creditors to have my credit files updated. So far I have used details on Experian to update my credit files there, although I am aware that I will also need to check Equifax and possibly CallCredit. I have a couple of questions arising:

    1. Having checked through my entire file, I cannot see any reference to my bankruptcy on Experian. Is this usual, and if not, where would I expect to see that information posted? (I'd have expected this to appear under the "Public record information" section)

    2. Whilst most of my credit arrangements went into default in 2009, I did not enter into bankruptcy until Aug 2011. All my credit account information has shown Dates of Default at various stages throughout 2009, however in updating my account information on 2 current accounts I had with HSBC, they have changed date of default from 20 Mar 2009 to 22 Aug 2011 (the date I entered bankruptcy). This is the only instance to date where a creditor has amended the original default date in this manner. Is it correct that they should do so? It concerns me that these two items will now remain on my credit file for a further 2+ years as a result. I don't know if this is relevant, but the two current accounts were held jointly in the name of myself and my wife, and Experian shows her records unchanged with an original Date of Default of 20 Mar 2009.

  • So confused with all this that I have put to one side for a year but really must get on with it...looking at my Equifax it gives default sum and a start date(13/06/2001) and a default date (06/2005) then underneath states end 30/06/2005 - i went bankrupt on 26.03.09 and discharged a year later but does that mean my default sum should read as settled or partially settled - and if the default date is earlier than my bancruptcy should I leave that alone?
    Its the same for a number of cards.....Equifax also give associate information which puts details of my ex....how can I get these removed?

    Okay I could do with some advice here tbh.

    I was declared bankrupt in 2007. I was discharged a year later. If I am correct the bankrupcy should come 'off' my credit file later this year?

    The issue is, I have never really been able to read and understand my credit file. I only found this site and forum a little while ago. Now, I have no idea if my entries have been declared as settled/partially settled or still in default.

    I am in the process of getting my credit file to find out, but the question is, if they are still showing as a default should I write to them or leave it, bearing in mind they have also got to be on or near 6 years now?

    If they are defaulted after your BR, depends on how long after really.

    If it's months or even years, then you will want to get them sorted as otherwise they will continue to hurt your credit file for a long time after the BR itself is gone. If only a short while after, it may not be worth the bother.

    Find out, then you can make that call.

  • My equifax credit report shows my A Notice of Correction = IVA 23/0/06 was removed from the Insolvency Service Records on 11/05/10. No other creditors associated to the IVA appear on the report at all. Can I assume that my credit reference now is cleaned up and also how long will this remain on my reference report is will it be six years and then disappear off ?

    I went through an IVA in 2006 which was completed on Jan 26th 2007. Barclaycard was the only creditor that hung around until the last possible day. Just after then, my Equifax and Experian files were clear of everything related to this matter. I assumed I was now able to move on. WRONG! Barclaycard had replaced the original entry with another one mid February which stated a default date AFTER the IVA was completed (by 6 months) and which showed a defaulted balance ever since. I applied, innocently, for a mobile for my son a couple of weeks ago and was surprised to be refused supposedly by CPW (I now know Vodafone had searched my files with Equifax and Experian) and I have also been told by a lender that they don't want to touch a remortgage application with them due to the Barclaycard entry. Of course, I immediately wrote to Barclaycard AND have raised a request for Notice of Correction with all three CRAs. As yet, only Experian have even replied, but all three files are basically the same as before other than the Voda search. My question is this: Barclaycard have not only made a massive factual error, but they are literally costing me money as my current mortgage is £265 pm more than the original offer. Can I take them to Court over this or am I just supposed to chill out and wait 28 days plus this plus that (i.e. several months) whereupon the mortgage deal proposed may have been withdrawn and nothing as good is available. This could have consequences for the whole duration of my mortgage i.e. 15 years and could amount to £1,000s.
