Bankruptcy Credit Reference File Clean Up - Discussion

    I have this on several of my entries, all it means (in the sense of bankruptcy) is that they have added a partial settlement rather than marking the account fully settled.

    The key is to make sure the default date is not later than the bankruptcy date, so no matter what they add after that date, it will all fall off when the 6 year default date arrives.

    Thankfully all mine go in march next year!!

    This is a problem I'm having with an entry on my file right now. I went BR in August 2009 and have one creditor marking the default date as April 2010.

    The creditor has already had the cleanup template letter and I submitted a notice of correction to the credit reference company, they contacted the creditor and nothing was changed.

    What would any one suggest I do?

    Send one very firm reminder to the creditor.

    If not corrected after a reasonable time from receipt of that, then make the formal complaint to the ICO. They are snowed under, and it will take ages, but no point hanging about.

    I'll find a copy of the reminder that did the trick for me.

    If you have an email address for the creditor's customer complaints/compliance/relations team and/or a company director, it may be worth emailing a copy of the complaint to them as well as sending it formally be registered post.

    FINAL REMINDER.

    NOTICE - LETTER BEFORE ACTION – BREACH OF THE DATA PROTECTION ACT BY CREDITOR.

    Dear Sir/Madam,

    I refer to my letter dated xx/xx/20xx and received at the registered address of your Data Controller on xx/xx20xx. Proof of your receipt of this is attached.

    In my letter I required you to correct the information on my Credit Reference Files in accordance with the Data Protection Act and the guidance issued by the Information Commissioner.

    I was declared bankrupt on xx/xx/20xx and subsequently discharged on xx/xx/20xx, and an account held with CREDITOR at the time was covered by this bankruptcy.

    Namely:

    Details of account(s)

    For your convenience I also included with my initial letter:

    List of documents you included.

    I required that you:

    - Mark these accounts in some way to indicate that these accounts are settled or satisfied.

    - Amend the default entry to be no later than <Date if your bankruptcy>, in accordance with the Data Protection Act.

    You had 28 days to correct this information.

    You have so far failed to comply with this request and your obligations under the Data Protection Act.

    Therefore I wish to remind you of your obligations and give you a final chance to correct the information.

    You have 28 days from receipt of this letter to do so.

    Should you fail to make the corrections required, further formal action will be taken.

    I would appreciate your due diligence in this matter.

    Thanks for that letter Fermi. I also need to use that as my first attempt at cleaning my credit file wasn't that successful, only a few corrected their entries.

    oh thanks that may help me, still waiting on Arrow Global, MBNA & TSB to sort my accounts out.
  • I've received my report from Experian but applied for it very soon (impatient!) after my ED. Credit Expert and Call Credit both wrote back requesting further info to verify my identity and address (frustrating, as it now further delays getting the info from them and also I'm reluctant to send off originals of passports/driving licence, etc as I may need them soon for a CRB check and don't want them disappearing into the ether). Is this usual?

    Anyway, it's now a few months later and I'm now going to get another report from Experian and send off the necessary info to get my credit reports from the other companies.

    One thing I'm confused about though... I'm keen to start repairing my credit files asap and have seen people talk about gathering 'green ticks' on their credit reports as they gain (and use) credit responsibly. I see no 'green ticks' on my file - is this a metaphorical thing?! My bank account with Lloyds (that I had pre-bankruptcy but was never closed) shows on there but is pretty much dormant, although there are a small amount of funds sat in there. My current Account, with Secure Trust Bank, doesn't even appear... surely it should? My mobile contract with Vodafone (changed to SIM only during BR) is on there and appears ok, but my Sky contract isn't there. What else can I do to start to rebuild my credit?
