    Hi Peachy .. haven't read all the way through so might be grasping at a red herring here :D .. but did you send them to PO Box addresses? quite often they aren't signed for as there's no one there!!

    Amex were one if the ones who didn't sign for their letter, BUT I got a letter from them today, with 'sincere apologies for any inconvenience or distress' and it goes on to say that 'Experian and Equifax have been advised to delete the entire entry for this account' from my records :j

    How very nice of them :D



    Waspy, I think all were sent to physical addresses, but I will double check, thanks for that.

    Just checked my file, and bingo, no trace of my Amex account at all

    But the email address for Royal Mail's Proof of Delivery (POD) team is:

    pod.team@royalmail.com

    Apparently they can often help in cases like this.

  • Below is a response Ive just received from Equifax. I was BR on 20.05.2003 and I ordered my reports from EQ & EX to see what was on them. The Equifax report is dated 22.05.2009 (6yrs 2 days after BR) and I was almost horrified when I received it. I wasnt expecting to see my previous problems on my file as I was led to believe they would only stay on my file for 6 years? Also some of the default dates were incorrect and dated after the BR date...

    I wrote to Eq to query this, basically asking about why everything dated with my BR date was still on the file and how to go about getting the incorrect info amended.

    The response is listed below..(the companies mentioned are all appearing on my report listed as defaulted with the dates beside them and nothing referring to satisfied, should they even be listed at all as the accounts were BR?) Im confused by the wording and would like someone to help clarify what is happening... Is it up to me to start chasing Max Recovery, etc to have them amend my default dates? or should that be the responsibility of the official receiver? I cant fathom out why things are meant to be recorded for 6 years but then still appear afterwards?

    These accounts are currently not appearing on our records.

    Intelligent Finance - Loans, Halifax card services

    These accounts are not currently showing as defaulted.

    Max Recovery (Barclaycard), Capital One Bank (Europe) PLC, Max Recovery (MBNA), Egg Plc, Barclaycard Centre, EGG banking PLC,

    If you wish to have accounts that were named as part of your bankruptcy marked as settled, you will need to contact each of the lenders concerned providing a copy of your certificate of discharge.

    You should ask for these accounts to be marked as settled with the end date of the account showing as the date of the bankruptcy.

    You’ll find more information about your credit report at: https://www.equifax.co.uk/help. If you have a question, you should find the answer in our FAQ section. If not, you can send us an online query, and attach your documents to it – no need to worry about them getting lost or delayed in the post.

    It is your responsibility to chase I am afraid.

    Records stay on your files for 6 years from the original default date, so if that date is some time after the bankruptcy date info can linger longer than it should.

    You need to write to then to get the default and settlement dates sorted.

    I'll give you an example of what I dont understand....

    Max Recovery - Credit Card/Store Card
    Started **/**/** Default £1340 Defaulted 20/05/2003 Current Balance £1340
    Status History 8 = The account is in default
    File is updated for the period to 26/04/2009

    1. I understand that the files get updated when creditors, etc choose to send the files to the CRA's, so that obviously explains why the above was updated until 26/04/09. What I don't get is that the default is more than six years ago so why does it still show there? Is it a case that now I have to wait until Max Recovery choose to do another update before it comes off the file?

    P.S the credit file was produced after 20th may

    I beleive it's because there's still a balance. So the account is still 'live'

    When you clean up your credit file it's important to have the accounts marked settled with a £0 balance for them to fall off your file after the 6 years.

    It should read:

    Max Recovery - Credit Card/Store Card
    Started **/**/** Default £1340 Defaulted 20/05/2003 Current Balance £0
    Status History 8 = The account is in default
    File is updated for the period to 26/04/2009
    Satisfied or partially satisfied
    Accept your past without regret, handle your present with confidence and face your future without fear

    That makes sense I guess... I take it Max Recovery bought this debt with the balance as £1340. Ive never had any dealings with them at all. I take it I need to call them and advise them that they should remove the default?

    One of my defaults were with Max Recovery, I emailed Eversheds.com as they deal with this sort of thing on behalf of Max Recovery. A guy called Jamie Dickerson got back to me and was very efficient at updating the default date for me.
