If that is not the case, then I will take them to court for sending me the wrong terms and conditions. :mad:

Are you talking about the booklet that is titled 'The Real Deal'? I don't happen to have that booklet, but for some strange reason I have a booklet entitled 'The Small Print'. I just downloaded the latest 'The Real Deal' booklet which does list the itemised billing charge, but it's their August edition so it's bound to include it.
I have kept everything I got from the day that I've received the phone and that's all I have.0 -

I did both. I emailed them via the My3 part of their website, that way you get a tracking number for your email and don't just get an automated response like you do if you use the general contact email on the website.0 -

Surely that isn't true.
If they reserve the right to do something, surely they have to notify you when they do - as they have, then when do they have changed your contract as they are not reserving the right, they are actually doing it - therefore a change has been made??0 -

Putting it like that, I can see your point.
They've essentially said "Ok, we've started trading in the UK and we may find it necessary to start charging you to receive an itemised bill."
So by implementing that charge for the itemised bill, they have indeed made a change to the T's & C's of the contract because they have done just that - changed the T's & C's to include a charge for itemised billing.
Also - i'd look in to the possibility of wether or not this charge is compulsory until you opt out, and it's up to you to opt out. That might be worth looking at.

The issue is really how can they notify us 10 months after a change was made to the contract (Price Plan Document) and expect to get away with it, saying we agreed to it when we were not told about it.0 -

This is going to be my argument - in a perfect world, we would have gotten a letter from 3 last year that said something like :
"From September 2007, 3 will be changing it's billing policy. All current and future priceplans will now round any calls under 59 seconds up to a minute.
This will be rolled out initially on the Talk and Text 999 plans, but 3 will be making this change to all existing price plans over the coming year.
All future priceplans will also be billed in the same fashion"
If we'd had a letter like that, we could have made an informed choice about our future with 3.
What happened was that 3 brought in this change by the back door and never told anyone until nearly a year later, and in some cases, when it was too late to do anything about it.0 -
I recieved my PAC code a couple of weeks ago, I had 5 months left on my contract. My normal 3 billing date was the 22nd of the month.
Went to O2 and got an iPhone. Number ported on the 22nd.
Can no longer login to My3 which I am not surprised about seeing as the number is now not with 3.
However have received a bill today for September. I am presuming this is the 30 days notice bill and that I should pay this one and then cancel the direct debit in case they try again to charge me.
Haven't had any confirmation letters or anything since I was given my PAC code either.
Anyone else ported their number away from 3 successfully?0 -
The guy I spoke to at the exec office said that I had to pay up till my 30 day date but that as it had taken them a week to accept my notice I should ask for credit of 7 days to take this into account. This means an end date of 19th sept for me and my letter of cancellation was sent on the 12th of August, the exec office gave my Pac on 19th August. . You should only pay up to 30 days after you gave notice it ha nothing to do with your billing date. What date did they give you your PAC?0
