Hi I'm with Flogas and live in North Yorkshire, I got a letter from them stating that a 'garden structure needed re-siting' in order to comply with new regulations and nothing can be within 3 metres of the above ground tank we have, when I called to query this they said they'd send someone round for a site visit, someone called round and advised that the tank doesn't comply with new regulations but also said that it was in the best possible location due to the size of our garden and garage location and a report would be made to Flogas, this morning the same person called to say he was measuring the garden as Flogas have said the tank has to be moved which was a horrible shock, not only had Flogas not contacted us to discuss and review the situation, but they are also saying that we have to move the tank even though there isn't really anywhere to move the tank to that would make it comply with all the new regulations they're stating it must comply with. Does anyone know if these new regulations do apply retrospectively to existing installations (our tank was installed in 1995). Can anyone recommend any others options for us? I've had a look into underground tanks but the thought of digging a big hole in the garden is daunting? Many thanks to anyone replying, I'm finding this all really stressful.0

The regulations are 3 meters from building boundary & source of ignition ie, fence, shed, drive. Has the garden structure always been there? if yes why are they requesting you move it now?
You also need to check drainage is not within 3 meters and no overhead cables directly over the tank depending on Kw.

When I moved into this property I was told the same when I started fishing around for new quotes. The tank is right next to a wooden fence on two sides and has been there for 12+ years.
The suggestion from Avanti was to replace the fence panel with concrete panels for a length of 3 metres. The issue being combustion and air flow (the bloody thing is outdoors so I don't understand the airflow bit).
I asked about the retrospective element of the regualtions i.e. surely this would only apply to new installations, but they were having none of it. However they did say that the 'regulations' were guidleines and they can apply some discretion when assessing.
So maybe an option is to get some suppliers to come out and review the location, they may come up with some cheaper alternatives to burying the tank.

Right, that's it. Fed up of the !!!!, I'm going to get my tank filled by another company. If I tell them I own the tank, will they require ownership papers or not?0

Yes you will need to supply a current test certificate and in some cases proof of ownership - sorry

test certificate is buttons I believe. May go down this route as fed up of being told we cant port contracts due to the location of the bulk tank. As there are are number of overhead cables around our property, we are stuck.

I've just bought 1000 litres at 45p/litre from my local supplier in Hampshire. Don't know how that compares with the bigger companies.0 -
