    Barclays profits have clearly increased thanks to me and my o/d charges so today I have printed the letter ready to post with my £10 cheque tomorrow!
    Yet I'm nervous and don't fancy going to Small claims court!! If I do I will arrange for my mate (a trainee Barrister) to represent me hehehe!!
    Am i doing the right thing?!!
  • Alliance & Leicester have filed an acknowledgement of my court order which I understand is fairly normal.

    BUT Barclays called me today. I have had an account with them for ages which I am overdrawn in but not over my limit.

    They called me today saying they have sent several letters to me asking me to pay in funds as seeing as I haven't responded they have removed my overdraft facility and I need to pay it back right away. When I asked why I hadn't received any of these letters they gave me my old address - DESPITE Barclays always sending my statements etc to my new and current address.

    I sent them a letter last week saying if I hadn't heard from them in 14 days I would file with the courts - is this them fighting back?????
  • Hi I'm new to the forum and need some help.

    I had an overdraft with barclays and as everyone here knows, they're rubbish.

    Anyways, the past 4 years I have been charged loads and loads to the point where I could no longer afford to pay for my overdraft as it was so high.

    So I gained help from the Consumer Credit Counselling Service.

    They pay an amount into my overdraft as agreed by barclays as it's the most I can afford to pay each month.

    I'm just wondering though if that means i'm going to have trouble getting these charges back as my account is pretty much closed and i'm basically paying off my overdraft by as much a month as I can.

    I hope this makes sense to someone as I need help on whether to persue this or not.
  • On 7th February 2007 I wrote and dated a leter to BARCLAYS requesting money back from them and included my copy statements and copy of charges calculator print out. It has been 13 days and I still havent heard anything from them and I posted the letter rec delivery. As tomorrow is the 14th day, if I do not hear from them tomorrow do I then send my third letter to them??

    You can claim but it is likely that any reclaim will go towards paying off the overdraft.

    The 14 days should be from when the bank would be deemed to receive your letter then you send the next.

    I was told by barclays that they are treating all requests as complaints. In their complaints procedure they promise to respond within five working days to give you a case number and allocate a person to deal with the complaint. As they have failed to deliver this you have every right to contact them and point this out! After all as they told me they are following FSA procedures!!!!!;)

    They may sound like they're helping you when they say this, but be careful. My guess is that they're using this to try and distract you.

    Make it clear to them, you are not making a complaint, you are making a claim for unlawful charges. They will be following your timetable, not the other way around.
  • I filed a claim on moneyclaim.gov.uk on 22/1/2007 and it was acknowledged by Barclays on 28/1/2007.

    When can I expect something to happen?
