  • Well, what can I say.

    Sent all the letters and they refused point blank to give me anything.

    I served A&L with a County Court Claim on Monday 5th March 07 and I got back an acknowledgement of service saying they were intending on defending the full claim. Not going well at all!!!

    Got back from work today to find a nice fat cheque for the full amount of £1200 plus court costs.

    The system works, woohoo!! Thanks Martin.

    N.B. I did get a nice letter as well mind you stating that "It is clear that I do not accept the terms and conditions for the operation of my bank account and they will be contacting me shortly to discuss its future operation."

    Bye bye Alliance and Leicester bank account!!!

  • I got home on Friday to find a cheque from A&L waiting for me for the full amount of my claim including court charges. They have closed my account but I wouldn't want to bank with them after this anyway! So keeping going with your claims you will get there.

  • Do A&L sign for there recorded letters? I sent my request for bank charges back on 15th March and isnt showing that they have signed for it.

    I have sent it to the Customer Service Centre in Bootle.
  • I have took it up with Royal Mail, I sent a letter to A&L to get to them on 02/03/07 via Special Delivery and the internet was not coming up with an a signiture, in the end i rang them up and they said it had been delivered but the signiture had been misplaced, i then requested them to put a copy in the post once thay had found it as i paid extra for a signiture, i received a signiture in the post and a brief letter from them stating that thay had that many letters going to them on that day that they didnt get individual signitures, so it was under a different ref no. if you ring them up and ask them i am sure they will do the same again. A&L have finally got the cheques cashed today and they had them 2 weeks.
    And yes the first letter goes to Bootle, the others go to Carlton Park

  • I am at stage three with letter having sent the last one threatening legal action if they don't repay. I gave them 14 days to respond and I am on day 10 now. Looks like they don't want to play ball or are calling my bluff. My next step is to issue proceedings via the Small Claims System. Is there any chance that I might get stung for costs. The total claim is £448.95 which is a combination of rejected S/O's, DD's and dailiy overdraft charges.

    Any advice greatly appreciated. :eek:

    Your have to pay the costs to issue the claim, i believe its £80 but A&L will have to pay it back along with your requested charges. Good Luck. Im still waiting on A&L to answer to my claim i think they have 2 days left to file a defence.

    I am at letter stage 3 with the Alliance & Leicester. The third letter was sent on March 10th and said that I wasn't happy with their response to my request to refund etc and that they had 14 days to make good. I am now on the 10th day and no response so my next option is to go via the small claims court (Total is £448.95) The amount is a combination of unauthorised daily overdraft charges, failed SO's and DD's. Is it likely that I will incur any costs or do you think I should continue and go for the throat??

    Any help, thoughts appreciated.
  • Hi - I issued my claim on the Moneyclaim.gov website yesterday, it's quite user-friendly. You can type everything in up to 28 days in advance, so it would probably be easier to put aside a quiet half hour to type everything in & review it, then save it all & you can start it all on the relevant day at the click of a mouse! I'm using the website at work now as well, I hadn't realised it was so easy.... no more solicitors letters at £80 a time, I can take unpaying customers to court myself now.
    It's much easier than I expected - you could always log on to the site & have a look round first, makes it all a bit less scary!

    When the time is up, file the court claim. You will need to pay the court fee to file the case. You shouldn't have to pay any costs, even if by some chance you were to lose.
