You asked what the next step was in your last post and I replied telling you HSBC online customers can view their full 6 years records online and I gave the link for her to register for it if she doesnt have online banking already. Take charge and cut out the middle man.
However, it may take two weeks for her registration details (username and password etc) for online banking to come through if she needs to this, sometimes only a few days. If the details turn up in the meantime you will get the information either way so win/win on this particular problem.
Right now just about all you can do is complain to the Information Commissioner about the delay. The banks are receiving thousands of data requests and obviously cant keep up or screw it up and the commissioner in turn is dealing with thousands of complaints about it. You arent the only one. I know that wont make you feel any better but I have suggested an alternate way of you to get the information, its up to you to take it.

Unfortunately she is no longer a customer at the bank or has an open account there, so I don't think that she will be given access to an online banking system. Also she is asking for statements for her card as well as her account.
If banks are making billions of £ of profit, they can afford to employ more data processing staff - there is no excuse for breaking the 40 day rule. I mean 40 days! People climb Everest and back in less time, make it to the moon and back in less time and Fillius Fogg made it half way round the world in that time! All I'm asking for is a printout from a database :mad:

The letter should have been adapted for a credit card account, i.e. instead of writing direct debit, standing order etc you should have put late payment, overlimit (or whatever terminology MBNA use).
However, they knew full well what you were asking for and it looks like they are messing you about. Put some pressure on and write to them again enclosing a copy of your original letter.
If they don't play ball report them to the Information Commisioner.

I sent the first letter to Natwest in December and around a month later, I saw that they had cashed the cheque I sent with it.
The letter was sent in December, the cheque was cashed on the 11th January and I've still not received anything.
Should I wait (as they have cashed the cheque) or what else should I do?
Any help would be appreciated, thanks.:heart2:

I started the DPA procedure on 13th of Dec 06 Royal bank of Scotland cashed my £10 cheque on the 12th of Jan 07 but due to work I have been out the country . Sent them the reminder letter 1 Mar 07 still nothing back, all sent by recorded mail. Seems like gloves are off and down to bare knuckles especially seeing the amount of profit that we have paid them.
What is the number to phone the Information Commisioner or will i have to write them.0 -
Can anyone give me a little advice please. Rang Abbey 2 months ago asking for my past statements they deducted £10 from my account and said no probs. To date I have only received 12 months worth of statements and a letter stating everything else is archived on microfiche and will take 8 weeks to recover, I didn't know at the time I could write to them and give them 40 days to comply! Does anyone have any advice on what I should do next because I think they are just stalling, Do I sit tight or is there someway I can force them to comply? Any help will be greatly appreciated0

I would write to them advising (not reminding as you hadnt mentioned it but this works instead ) that under the Data Protection Act they have 40 days from the date of your initial letter to comply with your request. I would add a line to this effect:
"The Information Commissioner has deemed microfiche to be a relevant filing system under the the Data Protection Act. As such, any of my data stored in such a manner must accordingly be represented in a fully legible and comprehensible form in accordance with my entitlement and not sent to me as microfiche. I do not anticipate any deliberate obstruction or delay to my request regarding this issue."
They will probably still delay, lots are, and lots of complaints are being made to the Information Commissioner in this regard.

I sent my first letter (requesting six years' statements) 5 weeks ago and still haven't heard back. I know the time limit is 40 days however, which I did state as per the template letter given on this site. I have a few more institutions to tackle after this one, and wondered if anyone else has had problems hearing back/are people generally using eg recorded delivery? May seem like a silly question but I'm a bit in the dark as I've only just started, and I'm dreading the bureacracy but looking forward to getting my money back hopefully one day!! I've looked through many of the threads, and can't find advice on this. Many thanks.0

I wrote to the halifax 9th feb 07 they wrote back saying I would here within no more than 4 weeks with regards to my bank charges. Which took me to the 9th March I then got a letter from them saying they were still dealing with the enquiry and that I would hear no later than the 5th April which seems quite funny as this is when the charges may be reduced and we will only get the difference0
