    at ironside - i've tried to check out providers of 24meg online and found that they say i can't get it, though i know others on my local exchange have it. this leads me to suspect our lines are locked for a period around this migration, but given what's happened so far i'm ringing bt tomorrow to make sure my phone line is still with them as most suppliers state you need a bt phoneline - scary thought.

    i'm also up for any class action and will gladly shell out a few quid to put these cowboys in their place

    I wonder what Clode would think if they saw this thread, I'm sure in their eyes alarm bells would start ringing, and as someone else said they should be putting some leverage on RT.

    Does anyone know where we would stand with reagrds to the finance agreement if RT go bust?

    I'm in with any group action.

    This is such hard work on such a slow connection, it takes about 5 mins just to refresh the page to see if anyone has replied. GRRRR..

    I wonder how you would calculate it?
    As I paid £17.99/month x 36 (ie £19.99 less 10% for being an idiot) I would expect to get back £17.99 x however many of the 36 months remain. My immediate thought is that the PC is irrelevant and I should keep it. It was free with the initial contract which I am happy(!?) to honour. The contract is being cancelled because of RT's inability to honour their side.

    As I posted earlier in this discussion Clode are washing their hands on the Redten (or as they call them Red 10) debacle, as far as their concerned you keep paying like happy customers :mad:

    Dear Customer


    With reference to your recent enquiry, please accept our apologies for the delay in response.

    We have liased with Red 10 since we were made aware of the disruption in service. I can confirm that this was due to Red 10 changing service provider to NJP Services from BT Wholesale. Unfortunately, BT chose to inform customers that service had been disconnected due to liquidation. I can assure you that this is not the case. Red 10 continue to trade and this has been a temporary interruption of normal service.

    Red 10 have confirmed that all customers internet connection should now be restored, if this is not the case, please contact Red 10 on 0844 482 0000 or alternatively NJP Services on 0871 424 0135.

    We appreciate that many customers would like to cancel their agreements, please be advised that Clode Retail Finance cannot process these requests. An agreement can only be cancelled on instruction from Red 10 the service provider.

    I would like to thank you for your patience whilst this matter has been investigated.

    And another quote from Clode after I queried that the contract had breached terms & conditions..
    The terms and conditions of your finance contract is not the same as the terms and conditions of the service arranged through red ten. If we, the finance company make any changes to our contract with you in relation to payments etc, this will be notified to you in writing as per quoted in our contract of terms. We have not made any changes.

    Your service provider is arranged through Red Ten, we cannot answer any technical or support queries that the retailer themselves are responsible for. You will need to refer to your terms and conditions of your contract with red ten.

    To put it another way they've got you over a barrel as far as keeping up payments, if you stop or cancel they will expect full remaining payments to be made for the PC as per the t&c's and will probably put your non payment on your record so it will affect your Credit Rating.

    I would personally like to see Martin Lewis (The bloke who owns this site as is pictured above) to get involved and to give some advice and guidance as to which way to persue things. 1 - Persue Clode, 2 - Persue Redten, 3 - Persue OFOM or other options etc available.

    For those who contacted WATCHDOG earlier last week - Did you get any response?

    Can you provide a copy of your terms and conditions that you believe you are working
    with. Can you also confirm whether the financial agreement through you for Redten (Not
    Red 10) is for the provision of Unlimited Broadband Access for 3 years or for the
    provision of a 'FREE' PC ? How is the monies payed to Clode divided out to the other
    parties (Redten, BT Wholesale and now NJP Services) do you pay NJP or do you only pay
    Redten? Is this a monthly payment, anual payment or a lumpsum payment?

  • According to the Consumer Credit Act 1974, Clode are jointly responsible for the service. And "so a customer can
    sue a supplier who does not fulfil his obligations for breach
    of contract. A supplier can also be sued if he persuades a
    customer to enter a contract by making a false statement of
    fact - or misrepresentation."
    Both Redten and Clode funding can be sued if the cap is not lifted. How to do that I'm not sure though, but will be looking into it.
  • I've had a thought:

    I think redten WANT us to leave.

    If we leave they no longer have to pay njp for broadband service for us (such as it is).

    Its simple. We leave, they save money.

    Found this useful information on a website, there's a whole lot more but I didnt want to post it all here, a few of the things were an eye opener (especially how useless OFCOM are). So if were planning to take Clode, Redten & NJP to task we better start somewhere....
    • Be careful if considering cancelling direct debits - These often result in your debt being passed to a debt collector.
    • Companies may attempt to fall back to the terms and conditions in your contract. Please be aware these may not be legally binding if they are in breach of the Unfair Contract Terms Act and other regulations regarding unfair terms in consumer contracts. This would be up to the court to determine and you should seek advice if you intend to rely on this.
    • You can report a problem to Ofcom for monitoring purposes but note that they will not investigate individual complaints. You should therefore consider other approaches to recover any losses.

  • Pheonixbrighton, you're really up for this aren't you? I wish you luck, I personally don't think the PR route is the way to go. Redten are getting enough bad press as it is, I don't think any more is going to do us any favours and it might even make us look bad, as if we're trying to make them go bust as that would be a result for us.

    I don't think regulatory is the way to go either, like they say they won't look at individual cases which as far as I'm concerned means they won't look at sorting out our contracts. They may look at a way of forcing Redten to improve in the future but they aren't going to fix our problem IMO.

    So the legal route is the way for me, if they give us a worse service than before (ie with a limit) then for me it's clear as crystal. We can cancel. But what we need to bear in mind is things like the cost of our time in fighting this, if it takes a few hours of my time then so be it, if it gets to the point where it's taking days then I'd be better off working and forgetting about it. Not that I would want them to get away with it but we have to remember to look after ourselves and our families first rather than seeking revenge.

    We also have to consider what the costs of losing the legal battle would be, would we then be liable for costs etc? Personally I don't want to lose money taking them on in court.

    So in summary, for me I think there are better ways of dealing with these things but it remains to be seen who will get the better result at the end of the day.
