  • Help , ive been dealing with claiming my charges back from the halifax since nov last year and only got my statements after 4 letters to them 21/2 weeks ago , i gave them 2 weeks to respond or i would starty court proceedings , its been two weeks today and no responce from the bank , under the circumstances of todays news should i proceed with court proceedings or not , help please someone , im disabled with a partner and two children to support and struggling like mad at the moment .
  • UPDATE : Now they are telling me they have 60 days as per the FSE to send me this list and I wont get my charges back until the court case they have in september is sorted, funny I never said anything about charges to them, AHOLES!! anyone know anything about this 60 day FSE thing? or their case in september, my understanding is its a data protection issue and nothing to do with the FSE??? I am now wondering wether to wait for my list or just ring a solicitor and start proceedings to get any charges back.

  • Could someone please advise me on this question. Quite some years ago before Neteller and sterling casinos I used to deposit using my Barclays Debit and Credit cards to online casinos. They were always in dollars. I used to win a lot as I was a bonus player. When I won, they refunded the credit card charge of my deposit (they never sent excess winnings back to the card- they sent winnings by cheque) but due to them charging 2.75% on each transaction, it compounded to nearly 6% less money back each time. I did try claiming this back because they had a policy at the time of returning the difference on any refunded purchases in a foreign currency. I was successful in the case of my credit card because I just had to phone them up to refund the differences over the phone, although some of the CS reps sometimes seemed a bit puzzled about what all these purchases and refunds were for. One even said they had never heard of online gambling but it was a while ago! Another thing was all the refunds counted as payments so I never needed to pay anything off even when I had a balance. I usually called them about once a month to do this. At one point though after I needed to chargeback a deposit for a dodgy casino that didn't want to pay, they wrote to me saying they wanted to close the credit card account after 30 days (incidentally I have since got another barclaycard). The trouble was by the end I had a balance of close to £2000 all from the foreign transaction fees. The Barclays agent just wanted to refund around £400 that had already been agreed and not include more recent transactions from the 30 days notice so I had to complain further. I did eventually get this back and had to sign a waiver of some sort (they called this a business decision as I was a good customer and a gesture of goodwill).

    Unfortunately, I also used my debit card and although I wrote to the separate department (the bank manager) I never received any replies about refunds to my current account for these foreign transaction fees. I stated that cards from Nationwide had 0% fees and it was unreasonable for me to be charged many thousands for something Nationwide wouldn't charge for. I had around £5000 of these fees from my debit card alone.

    I am wondering if these fees are recoverable as they are not exactly the same as the fixed fees you are talking about on this thread. I know they did have a policy of refunding them but I just wasn't able to get in touch with the right people regarding my debit card. I could only sort it out with my credit card account.

    Apologies if this has been asked and answered elsewhere already.

    We finally got all our bank statements-HBof S On Friday--the same day as the news report.

    is there any point in me spending hours gooing through them and adding the charges up and completing the claim letter--or do i just put this down to another lucky white heather episode--too late again

    No, I would do the work - this way your claim is at least registered with the bank.

    The charges from online gambling sites are treated as cash withdrawals and are not reclaimable, neither are charges from foreign transactions.
  • They weren't treated as cash at the time (they knew it was gambling through a code on Visa transactions so it wasn't that they didn't know) but I know they are now treated as such in most cases. At the time they were treated just as normal purchases. Incidentally, Barclaycard at the time didn't even charge late fees of any sort which was unusual for a credit card even then.

    It is just that Barclays' Policy was to refund the differences and I even had refunds from Capital One. This is when for example I deposited $1000 and got $1000 back. There would be a shortfall of about £40 each time after their 2.75% fee each way (the dollar was worth over 70p then). I could get these refunded but not with my debit card. It added up to about £5000. I suppose I could try taking them to court but would I have a chance? I honestly believed they would refund these amounts from my debit card too as they had done with my credit card.

    Anyway, this is on a wrong thread to be honest, sorry.

    Well took the advice and have just sat and added them all up--not sure if i should cry or kick myself hard in the backside for not having made the time to do this before or shout at myself for allowing these charges to be incurred.
