    OMG where have I been all day?? I've only just heard about this test case lark.... Tillybella I am so sorry that your 2nd claim has been frozen you must be gutted!

    I am so relieved that my acceptance letter would've been received by HSBC this morning - surely they can't back track once an offer has been made? I bloody hope not!!!

    Let's keep eachother posted - keep chins up, I'm sure it'll all be ok, and bank charges from now on will be vastly reduced......

    It's a complete nightmare!! Now I'm kicking myself that I didnt get my claim in earlier! No point in crying over spilt milk I guess :cry:

    You are fine, if they have made an offer then they have to honour it. Why couldnt they have waited a week for me to get my offer! :mad:

    HSBC told me it could take up to a year :eek: to be resolved. I hope it is sorted a damn sight sooner than that!

    (By the way, is your husband really a giant?! :shocked: )

    I think exactly the same as you, they will come to an amount which is more acceptable, and refunds will be made on that basis. We knew that one day it would have to be lowered but the way they have gone about it secretly has left alot of people in the dark. I know they are honouring people that they have made an offer to, but surely the people that have written and are in the process of waiting the eight weeks or any other claim that has been governed by the time limits should still be dealt with. Just all new claims as off midnight last night would have to wait. I m no expert (far from it) but they should still be dealng with claims that have been in the pipeline for days going into months before freezing them.

    I agree totally, all claims being processed should be finalised but all new claims should not be accepted until the ruling has been made. Imagine if your claim is 8 weeks old tomorrow! I would be devastated, 4 days away is bad enough!!! Like we know though, the banks are a law unto themselves and do what they want when they want! :mad:

    Well how were any of us to know this would happen now? :confused: I guess with the amount of success people from all different banks were having claiming their money back, it had to end somewhere.... but I agree with you and Lou, they should acknowledge and continue to investigate all claims which were registered on their systems before the test case :mad: :mad: :mad: I guess we'll find out more over the next few days.......

    As for my husband he is 6'6" and since I am only 5'3" I guess you could say he is!! He had been feeling quite jolly especially when we found out we were getting our money, but he's a bit concerned now........

    i never wrote to the FO i just went staright to the court process after bank never replied to my 2 standard reclaim letters, i first put my claim into court 16 april mcol.
    I was just waiting for a court date that was meant to arrive this week, if the oft decide to honour all the compaints that are in teh system will i miss out because i went staright to the court process. I'm so annoyed as this has been dragged out after i had a stay put on the case etc and now nearing the end and this happens!!!

    Can I just clarify a few points. OFT is the Office of Fair Trading and it is them who are challenging the banks with a test case. They do not take on bank charges claims, this is/was the Financial Ombudsman or the FO.

    Please read what HSBC have on their website....

    To any HSBC user with an offer on the table at the moment, accept it in part payment and without prejudice and that you will continue with your claim for the remainder once the test case has been resolved. Make sure the bank understand that your case has to remain open.

    For anyone with a court case looming, phone the court and ask them what is happening with your case as they are the people who will know.

    does anyone know if we are likley to get our court fees back from mcol, at the end of the day my case hasnt and probably not likely to be heard now so why should i have paid for soething that i havn't recieved, anyone in the know. It just looks like i have not only lost my bank charges but an £80 court fee, thats alot of money to me!

    Was wondering if anyone could advise me on what I should do next.

    Have been going down the suggested routes of claiming my bank charges back from HSBC. They have just offered me roughly half of what I claimed and they have given me 1 month to respond. Due to the suspension of claims during the test case, should I accept this payment on the premise this may be all I get?

    Please help!

    If you have already commenced Court proceedings then these will continue. In all other cases offers which have been made will be honoured. If you do not want to accept the offer you are still entitled to commence proceedings.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    Accept the offer they have given you in part payment only and without prejudice but that you will be continuing your claim through the courts. Make it clear that your acceptance does not entitle the bank to close your case at this stage.
