hi, im in the process of claiming charges back from Lloyds. Ive had all my last 6years statements returned to be and they add up to just over £6,000!!! Does anyone know if this is too much to try to claim back..im very worried..help!0

The banks would have classed the charges as revenue, and so this would, along with the rest of their revenue have been subject to corporation tax after expenditure. Therefore any refunds given to the consumers would actually benefit the banks in a small way since they will pay less corporation tax next time due to the fact that the refunded charges will hit their profits. So actually they aren't defrauding the taxman (although I'm sure they try to maximise as many loopholes as possible... :rolleyes: )
Sure the banks class this as revenue even though the figure is monopoly money. But, it's false revenue they reclaim. They could make up any old figure, charge the customer and then say it was a bad debt. This means that any business with a bad debt can add charges ad lib and claim the total back thereby reducing their own corporation tax liability. If the Inland Revenue caught a company doing this, all hell would be let loose.

Problem is that in the County Court you have a £5000 limit.

Yes, but do not forget that this is your money which has been unlawfuuly taken from you.
Why should you let them get away with over a grand of your money?
Push for the lot threatening court action as well, but the final decision is yours. Take the easy route and probably settle for 5k or a little extra work for what you are owed.

Hi peeps
just looked at my claim on MCOL and it says "jugdement halted" and cannot go any further on line. But have'nt had any questionaire come through the post. shall i just sit and wait!!!!

Presumably you've had the bank's defence come through the post? At this point, MCOL ends and everything is done by post from now on. Just sit and wait for a court date, at which time you may learn whether or not you have to fill in an AQ. They seem to have been dispensed with, but in some cases, they're still being asked for by the local court when proceedings are transferred.Wins since 2009 = £17,600MANY THANKS TO ALL OPS0 -

For all you people contacting Barclays Bank, the link below
shows their own staff admitting the charges are wrong.
It will serve as a gentle reminder to them. A Barclays manager states that to bounce a cheque costs £1.50 - £2.00 and they charge customers £30 - £35
The video starts with an ex employee of the Yorkshire Bank
whose job it was to cost every item. No more than £2.00 to bounce a cheque !
Suffice to say that the Yorkshire Bank refused to comment ..... what a surprise !!!!!
PLEASE REMEMBER:
The law is plain: any charges banks levy on their customers must be proportional to the actual costs.
THIS MEANS IF THE COST IS £2.00 THAT'S WHAT YOUR CHARGE SHOULD BE

ANYTHING ABOVE THE COST CANNOT BE CHARGED AND THE BANK IS IN BREACH OF THE LAW THEREFORE MAKING THEIR CHARGE ILLEGAL
