  • Just like all the private invoices just ignore them, they are toothless. Do a search and see all the posts about them and how everyone ignores them.

as per jamiestar 5 we were also sent civil infringement notices by CELtd re 'coppins bridge'. On the advice of the local trading standards we wrote back stating we would be appealing as on the night in question, I, as the registered owner, was not the driver - which I genuinely wasn't!
However we have now had a reply refering to
"..the ruling in Combined Parking Solutions v Stephen James Thomas (2008) The judge in this case held that on the balance of probabilities, the Registered Keeper was the driver and even if this was not the case - he took a dim view of the Registered Keeper's attitude for not providing the driver's details to enable the matter to be resolved at the earliest opportunity. The registered Keeper was directed to pay the outstanding parking charges and legal costs." Hence they still want the money.

Any advice gratefully received - also do these 'things' show up on searches etc - we may be moving!
    thanks

The Thomas case is nothing to worry about - it was 2 years ago and seems to have been a set up case by a PPC just so they could use it to frighten people like you.

You can absolutely ignore your ticket and all the stupid letters they will send you. Do not appeal again, do not reply to letters, do not accept any phone calls (unlikely but some do try this if they get your phone number among the details they get from the DVLA).

No bailiffs will be instructed and they can't just 'apply for a CCJ' - even if their letters may be written in such a way to suggest this (very misleading but common).

This is NOT a real fine. It doesn't show up anywhere, is NOT a debt hanging over you and does not appear on searches or on your credit rating AT ALL.

If you had received scam emails from Nigeria telling you to pay £100 to 'claim a prize' and you had deleted those emails, would you worry that they would show up on a search? Of course not!

This scam is the same sort of thing, believe us.

Click on the blue linked words 'parking fines, tickets and parking' at the top of this page just underneath the orange Banking Saving tab. That will take you to the whole current forum on this subject. Read the first sticky thread which shows you what letters to expect. Then when the 'debt collector' and 'solicitor' letters arrive, laugh!

Really, they are not serious, this is a scam and nothing more. You have NOT been fined and have NOT committed an offence. They will NOT take you to Court and the letters will fizzle out in a few months.

Oh yes, and once you've read the first thread on the forum, read as many others as it takes to convince you that ignoring this fake ticket is the right option. Trading Standards sadly don't have a clue about this scam, generally. For instance, they really believe there's an appeals process because the tickets say there is, LOL! :rotfl:

After ignoring 3 letters from Civil Enforcement Ltd, I've no recieved one from Newlyn who claim to have been instructed by CEL to recover the parking charge.

    £238+

Obviously I'm going to ignore, but do they not send 'their' people round to the house?

Not worried for myself, but more if the missus and kids are in the house alone.

Newlyn is a just a debt collector, not a bailiff. Only a Court can appoint a bailiff and that's after you lose a Court case and then refuse to pay in good time!

Debt collectors have no powers at all - but theoretically they could telephone or call at the house. Just say 'no thanks' or order them to leave in 30 seconds, whichever approach you prefer, both are fine, treat them like any unsolicited caller really.

But if you just google two simple keywords like 'Newlyn parking' and look at results from here, pepipoo.com and Consumer Action Group forums you can read other relevant threads which will show you what happens in terms of letters. I suspect that's all they send, not sure if they then send a final demand on Solicitors' headed notepaper, some PPCs use Graham White. Google that as well and you'll see it's nothing to worry about!

Stop fretting, this is not a debt, there is nothing hanging over you and debt collectors cannot enforce anything - let alone a non-existent debt!

    Hi W1zz,

In the 3 years that I've been on their radar Newlyn have never sent, (or threatened to send) 'anyone round' & to the best of my knowledge it's not a strategy they have ever adopted in 'private parking' cases.
They rely purely on trying to wear you down with several threatograms which eventually do stop.

So continue to ignore, relax & tell the missus to do the same.

No they don't, they are not going to spend money on fuel just to be told to go forth and multiply. I've had threats of home visits and I wish they would, my dogs would just love to meet them.....

Do you mean that you would like to show the letters for the greater good of the posters on here? You know that you can ignore all the letters but if you have a full set and are happy to scan them in then it helps the forum enormously. We don't have CEL examples yet, and other new posters are very reassured if they can see what to expect and ignore.

:T If you are happy to do this - now or later on when confident that ignoring is safe - then yes please, host the pics on tinypic without any ID details, references, dates, barcodes or payment slip details, on here:

    http://forums.moneysavingexpert.com/showthread.html?t=2214803

As you are a newbie, you will need to leave a gap in each link between the http: and the // in your reply; Crabman will then convert them to full links for the first post.

But if you are asking questions about whether you can ignore these and are still unsure, don't post questions on that thread as it's for info only.

Be absolutely assured that nothing will happen, they'll just send a series of letters pretending they are going to take you to Court and then that will be it. Most of us have had at least one PPC ticket and letters (Taxiphil has had a few...!). We have all ignored the lot and we know this course of action is safe, you only need to take notice of real Court papers (which won't arrive, honestly, the threats are empty).
