  • My flight number ZB7449 From Malaga to east Midlands has been denied compensation from Monarch. Over 5 hour delay!!! I have tried to see if CAA can help me but when I type in the flight is from Malaga they flag up they only deal with flights from the UK…. Any ideas on how I can challenge the outcome Monarch have given me? Like many people on this thread, not only were we delayed but Monarch have not handled the customer service relating to complaints very well at all! The only time I got information was by contacting them myself. It has taken them over 8 months to tell me I'm not entitled because it was extraordinary circumstances! I wonder how many times they will use that as a 'get out' clause!

Have a good read here https://forums.moneysavingexpert.com/discussion/5173888
If it was extraordinary circumstances like weather or ATC then they are correct that EU compensation is not payable
  • Hi everyone

Just wanted to see if anyone has had a successful flight delay compensation from Vueling or Tap Portugal? I have 2 different scenarios that I need help on (urgh...yes I have been so unlucky to be delayed more than 3 hours more than twice!).

Firstly, my flight with Vueling to Italy Rome from London was delayed for 4 hours due to air traffic controller strike. This said, when I used Resolver to email Vueling, they quoted that it had to be delayed for more than 5 hours to be compensated. I'm pretty sure this is not true as it is stated on this website and everywhere else that the EU laws specifically said 3 hours. Just checking if anyone had the same issue? I will respond and pushback to say the regulations said 3 hours, but doubt I will get any response from them?

Secondly, I was delayed by 12 hours on my flight with TAP Portugal from Lisbon to London due to pilot strike. I haven't started the compensation process on this yet but just wanted to find out if anyone has had a successful claim from them? I just know the process is going to take a long time and they may not even respond so wanted to get as many tips as possible on how to proceed.

EU travelling has got to be easier than this!! :(

We were delayed for nearly 7 hours on a flight from Heathrow to Hanoi for technical reasons.
We sent the moneysavingexpert recommended letter with our details in it, claiming 600 euros each. They have responded with a 'without prejudice offer' of 200 USD each - as a good will gesture. They say it was technical reasons out of their control.
Should we reject this and request the full 600 euros quoting the legal stuff, or could this jeapordise our chances?
    Thank you

both incorrect. ATC strike is out of the control of the airline so it does not matter how long the delay is, compensation does not apply

You will find this post worth reading https://forums.moneysavingexpert.com/discussion/5173888
then you can post on the "other EU airlines" thread where the other TAP strike posts will be

Thank you Caz. I have read it and other info on the Internet, but I have a specific question regarding the fact that they have offered us some compensation, just not the full amount. I am inclined to reject and quote the legalities and push the full 600 euros, but need to know if this could harm our case.

personal opinion - I would go back with a "thanks but no thanks" and give a notice before action giving them x days to pay up before starting court proceedings quoting the relevant case relating to technical problems not being extraordinary circumstances
  • Hi

Just wondering if anyone can offer help on if we are entitled to compensation for our delay.

We were recently on a flight which was from Helsinki to London but got delayed before boarding by 4 hours. (3 hours 50 minutes late on arrival to London)

When I asked the reason for the delay I was told it was due to the fact the airplane we were to be flying on was coming from London but before that it had been in Rome and 2 days before there had been a fire at Rome airport which caused delays.
First the people in London were delayed and lastly us when the plane arrived for its final pick up of the day.

I would know where I stand if the airport fire was at my departure or arrival airport but how relevant is it to my compensation rights for them to use a irrelevant airport to us as an excuse and a fire which happened over 24 hours before? It all just seems a bit of a stretched excuse.

Appreciate any help you may offer!

Vauban's guide should answer your questions but the fact that it was from an incident unrelated to your journey days before looks like compensation should be due
