Yes indeed that was one of our points.
I told them we'd spent £70 and to check my loyalty card (so they knew we were genuine) and that my mother was so upset by this "fine" (I know it's not -- but she doesn't) that she would never go to this store again. I also told them that she also was seriously in a panic about paying this as she thought the police would be involved (bless).
The reply mentioned this and said that they hoped she'd reconsider her decision! Well done Matalan/Land owners.

This is my first post so forgive me if it isn't in the right place or format.
Using the information on this forum I have successfully challenged a smart parking ticket given to my disabled mother in law at Asda Widnes. She had a blue badge in car but it had slipped from view. on receipt of ticket she went immediately to customer services and showed her blue badge but was told by Adsa to appeal through smart parking. Using the advice on here I contacted the store manager who said they would cancel it but after 3 weeks she was still messing me around. During this time my mum in law has been diagnosed with lung cancer and undergone surgery.
I then emailed the CEO Andy Clarke, indicating I was surprised at the lack of customer service given by Adsa managers and I think its despicable how they have discriminated and attempted to extort money from an ill, disabled and vulnerable woman. I also informed them that I know other people have had their tickets cancelled by the store managers. The issues have been resolved within 2 days. Ticket cancelled and promised flowers and vouchers as compensation.

She has told me that each customer services desk has the ability to have tickets cancelled in genuine cases, but emailing head office definitely worked for me:j0 -
Circumstances apart (so sorry to hear about your MIL - I have personal family experience of this dreadful disease, so can empathise with your situation) this is a good result and an encouragement to others dealing with the Asda/Smart axis on PCNs.
Just to be safe, please await the confirmation of cancellation from Smart (rather than Asda). Hold on to all paperwork until such time as Smart confirmation arrives - then hold on to that as claims can be brought to the Small Claims Court for six years following!Please note, we are not a legal advice forum. I have just got parking eye pcn cancelled after emailing Simon Wolfson CEO of Next (Simon_Wolfson@next.co.uk). I got the ticket from Forster square retail park in Bradford and emailed several stores that I'd shopped at that day. Next were the only ones that would help, even though I no longer had my receipts. Great customer service on this occasion!

Spent 45 mins in lakeside car park where machine was "machine not in use"
Received PCN from Parking Eye.
I wrote to LDNPA stating that m/c was out of service etc - spent £££s in local hotels/restaurants/businesses etc (all true) - received email back to say they would be seeking confirmation from PE of the machines status at the time.
Now I also used Parking Ticket Appeals Ltd - you pay then £16 they do all the paperwork to appeal to the PPC and POPLA if subsequently necessary - if appeal unsuccessful (unlikely) then they settle with the PCC on your behalf.
So I'm unsure whether it was the influence of LDNPA or the first stage appeal by PTA Ltd which did the trick but either way a satisfactory outcome I believe.
Incidentally all you need to appeal yourself is on this forum - I just chose the use PTA Ltd for convenience as I was extremely busy with work at the time.
PTA Ltd are a Yorkshire company too so all the better (especially as PE reside over the border in the badlands):p0 -

I will arrange for your PCN to be cancelled.
If you had brought this issue to the attention of the store after the first letter we could have stopped it from getting this far. The Parking Controls are not in place to penalise our genuine customers, they are actually there as a benefit to our shoppers as they prevent the car park from being abused by non-shoppers thus ensuring spaces are available.
If you feel that in future you require more time to shop and use the stores facilities please make this known to the customer service desk at the time, they will be able to prevent a PCN from being issued if you need to overstay the maximum time allowance.

Just had the POPLA appeal notification through. Nothing new to report, just another case where Parkingeye didn't even bother to present a case, so my relative won by default after I put the appeal together for him. He had overstayed the 3 hour limit by 45 minutes after being held up sorting out various complications for a holiday at a Travel Agent's on the Kingswood retail park in Hull. The £800 receipt for the holiday was ignored by ParkingEye.
I've been following this board for a good couple of years since my wife came a cropper at the very same place. Ignoring did the trick then, but with ParkingEye's recent penchant for court, it was a good exercise in going through the stickies, getting familiar with the appeals points and putting a decent case together.
I used a couple of specific signage issues at Kingswood, so, as ParkingEye didn't even respond to the appeal, it's likely they'll still be relevant for anyone else who picks up a PCN at the same location.
