    Just a quickie to say thank you for your advice. I got a PCN for overstaying my welcome at Lidl in Peel Street, Barnsley by just a little. I read the sticky post by Coupon Mad and sent Athena an appeal using the suggested wording, together with a scanned copy of the receipt showing I had been shopping there. Within one week of sending the appeal and within three weeks of visiting Lidl I have received a CANCELLATION letter.

    Just a quick update to say I helped my niece appeal a charge from UKPC using the template 1st appeal in the sticky NEWBIES thread.

    Anyway the appeal and one strongly worded follow up letter when they carried on sending out more hamster cage bedding and you'll never guess............they've only gone and cancelled it!

    Thanks for the information posted on this site which has enabled me to be successful in an appeal against VCS Ltd for a PCN issued for my vehicle stopping on a roadway at Humberside Airport where no stopping was allowed.


    The salient point of the POPLA decision as follows:





    The Operator issued parking charge notice number VC03061178 arising out of the presence at Humberside International Airport, on 22 December 2013, of a vehicle with registration mark xxxx xxx.




    The Appellant appealed against liability for the parking charge.

    Reasons for the Assessor’s Determination

    The operator issued parking charge notice number VC03061178 arising out of the presence at Humberside International Airport, on 22 December 2013, of a vehicle with registration mark xxxx xxx. The operator recorded that the vehicle was stopped on a roadway where stopping is prohibited.


    The appellant has made various representations; I have not dealt with them all as I am allowing this appeal on the following ground.


    It is the appellant’s case that the amount of the parking charge notice does not represent a genuine pre-estimate of loss.


    The signage displayed at the site and the case summary provided as evidence by the operator show that the amount of the parking charge notice is a charge for liquidated damages in respect of a breach of the parking contract.


    In order to justify that the amount is a genuine pre-estimate of loss, the operator has submitted a breakdown of the losses incurred by themselves as a result of the appellant’s breach. Amongst other things, the operator has included costs such as the debt recovery process costs, which do not amount to a genuine pre – estimate of loss as the operator has not incurred this loss as a result of the appellant’s breach. I find that the list submitted by the operator does not substantially reflect the loss suffered as a result of the appellant’s breach. This is because It appears that a substantial portion of the costs refer to the debt recovery process. I am not minded to accept the debt recovery process as part of the justification as not all parking charge notices will go to the debt recovery process stage.


    Considering carefully all the evidence before me, I find that, the parking charge sought is a sum by way of damages. I also find that the damages sought on this particular occasion do not amount to a genuine pre- estimate of loss.


    Accordingly, this appeal must be allowed.

  • Hi another successful appeal to store who has UKPC operating outside.

    I recieved a ticket on Sunday for parking "in a hatched area" outside Matalan in Colindale. Five other cars also received tickets at our time (1 hour) and so I can only wonder at the revenue being generated here by people scared into paying!

    On Monday I Googled and found the CEO of Matalan and sent a polite email explaining that the disabled bays were full and as my elderly mother could not walk far, we had parked as near to store as we could.

    I received a reply by email within an hour to say that the ticket had been cancelled and to apologise to my mother!

    Thanks to all the forum helpers!
    I did also appeal using the template but I guess I won't need to!

    Well done steph.

    Direct complaints to the principal of the contract between the retailer/landowner and the PPC can be the quickest way to knock this on the head - as you have proved.

    This process is two-fold - it can get rid of the PCN, but it can also (more powerfully at a strategic level) reinforce in the principal's (organ grinder's) mind just what a deleterious affect the PPC (monkey) is having on genuine customers' attitude to continue patronising their business!
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
