Well done, but why only £695?

We wrote to Thomas Cook using the guide lines after a 5 hour delay in Ibiza last year.
We asked for 400 euros per passenger - (1200 euros total) in line with the distance/time delay and today we got a voucher to be used against any Thomas Cook holiday to the value of £695.:T
We are very pleased with this and was definately worth writing a letter to them. Thank You Martin Lewis :beer:and MoneySavingExpert.com :rotfl:
A very happy house here this morning!!!! :j :j

    SUCCESS!!

I updated a few pages ago stating that TC had advised of their correspondance of the Bradford address. I can confirm this morning that the legal department of TC is still situated at that address and is confirmed on their headed paper.

I am so pleased - i received 2 letters in the post this morning. 1 was the defence to the claim. The second...

    Dear LisaLou1982

Claim v Thomas Cook Retail LTD

I write in reference to the above matter and further to my letter serving the Defendants Defence, also dated 10th June

Shortly after drafting the defence and covering letter, i received instructions to settle your claim

I can therefore confirm that i have raised a cheque for £760 in full and final settlement of your claim. Please confirm to the court that this claim has been settled on receipt of cleared funds. I would hope that the cheque would be with you within 7-10 days but feel free to contact me if this is not the case,

I trust that this is satisfactory

    Yours Sincerely

    Daniel Petty

So anyone else on the TCX4325 Tenerife to Birmingham flight - get that claim in!

That's unfortunate. What I really need to know is the real reason for the delay from Palma to MCR before I proceed to MCOL. TC state "industrial action" in their rejection letter but we were told "technical issues".

How do I prove this - no joy on Flightstats? Wish I could locate anyone else on Flight TCX 2103 on 28.6.2011!
There was an airport workers strike in Greece on 28/6 and 29/6/11. This had been publicised from 26/06/11, giving airlines adequate time to reorganise etc.

Ok well just an update to my claim.sent first letter of to TC at Peterborough on the 29/03/2013 the second 22/04/2013 to Peterborough 14 days after that i called TC Falkirk and was fobbed of saying they were looking into it. I then got a call on the 15/05/2013 saying that they were now looking into my case and the reason for the delay was TC peterborough do NOT deal with the claims anymore and all paperwork had been sent to Falkirk and please allow upto 28 days to have my case delt with and a reply to my claim. Just got of the phone to Falkirk now 12:27 12/06/2013 and was told they still have not had a response from the investigation team as to the reasons for the delay of my flight. What a load of time wasted so far still no nearer sorting this out. Hope the rest of you can get sorted out quicker.

Don't bother with the AESA, their opinion has no credence in British courts.
Beg to differ, we are talking about legislation from the ECJ. We are depending on that legislation to get our compensation, TC are trying to hide behind it. Article 16 gives member states the power to delegate bodies to enforce these regs. Granted suing TC for your compensation is a civil matter, however a positive response from a NEB should be a hefty weight behind your case, obviously you need to back it up with other relevant evidence.

NBA now? if you intend to pursue to court. You have given them plenty of time.

Do you have a claim number yet?

I sent my first letter in May giving 14 days to sort my claim as per the template. Exactly 14 days after that i got an email giving me a claim number, but saying they need more time to investigate. I stepped it up (as they hadn't sorted my claim within the 14 days) and sent my NBA giving a further 14 days (i might allow an extra week to be kind) but then i will take things to the next step after that, e.g. court!

BTW both my letters so far have been sent to an address in Bradford (Adwalton Moor Business Park, Birkenshaw & both were signed for the next day).
