I'm thinking of starting a claim but worried if I end up in the small claims court and win, can the airline then appeal in which case could I face financial ruin by having to pay their costs (and my own) if they ended up winning?

The short answer concerning their costs is almost certainly not, but if you suffer from insomnia and want to read up on all the exceptions, it's CPR 27.14(2) HERE0 -
Hi, please can someone offer some advice. We had a 6 hour delay on our flight from Manchester to Florida May 2011 (and two hours coming home). We flew with friends and they have just today had an out of court settlement with Monarch. I wrote and did the two letter complaint saying we wanted our 600 euro at the time but never pursued through the court, mainly due to the fact that I had a small baby. I would now of course like to follow this up and claim my entitlement for a substantial loss to my holiday, for the frustration and for the stress caused to my two small children that 24 hours of travel endured.
I am not sure if I should just start the court process as the ruling has just changed or write a letter and give them a chance to do it outside of court. If you think I should write, any advice on what should I say.

Send them a letter - to the Company Secretary, copied to their EU Claims Department - reiterating the key points, and advising them that they have 14 days to settle. Then, when you fail to get a response, you can commence your court action via MCOL - which is pretty straightforward.
There's quite a bit of evidence emerging that Monarch are in fact prepared to settle with folk - but only after they start Court action.0 -
Just received a phone call from Monarch to say i will be getting paid out for my delay in June last year. I was delayed 4hrs and 2 mins, and I said to the hubby that they would try and say it was less than the 4hrs so they only have to pay half, guess what they did. I have been on flightstats which states we were delayed 242 mins, so i have forwarded this email, but not holding out much hope. But I suppose i should be grateful for something.0

Can you provide the details of the flight, and why you were delayed? Did you take them to Court or just fill in the forms? You don't have to accept only half of what you are owed, but without further details it is hard to advise.0
