  • Does anyone (on the MSE team?) have a link to where the February 2005 date is in black-and-white (I'm currently trying to find one)

    My Manchester-Keflavik flight is a fairly straightforward case but for the June 2006 date. I had this reply from Icelandair today:

    "I am in receipt of your letter dated 22/02/2013 and am very sorry to advised you that Icelandair will not be taking your claim further due to outside the time limit of claims.

    The applicable law on limitation in each country depends on the type of claim brought by you and the general limitation period becomes applicable to each claim, based on the letter you have sent, the time limit is outside the period and therefore
    Under the EC Regulation 261/2004 for delayed flights, I am sorry to inform you that Icelandair will not consider your claim."

    You should have read the FAQ first mate. 6 years is the claim limit for the UK. You're out of time!

    Just to let you know we have each had £482 paid into our accounts from American Airlines :) To give an idea of time scale we had a 24 hour delay on the 26th November 2012 and sent off our first online claim form from American airlines website on the 28th November. Many thanks to this website .
  • Hi, can I claim for a flight delay from New York JFK to Manchester because the original outbound trip orginated in Manchester or does the fact it was taking off from JFK mean I can't claim? Our flight was turned back due to maintenance staff error (they admitted it) an hour after leaving JFK and we then waited another 4 for another flight. Total delay was five plus hours.
  • Perseverance pays off...

    Three of us were delayed by 12 hours in March 2012 on a Heathrow to Toronto flight. After writing to Air Canada they replied that the reason was a technical fault which they deemed out of their control and therefore denied compensation. I escalated to the CAA who claimed not to be able to help at that point but advised keeping an eye on the ECJ appeal due to opine in the autumn last year. Seeing that the ECJ then confirmed technical faults were not deemed outside an airline's control, I wrote back to Air Canada in January this year quoted the judgement, included the previous correspondence and they have now paid us £522 each. Probably took me 3-4 hours in total effort, but 10 months later now have something to show for it. Thank you MSE for all the info that helped us secure this!
  • I have an ongoing claim with Jet2 regarding a 5 hour delay from Barcelona to Leeds.

    I complained to them, got the extraordinary circs/unexpected flight safety shortcoming fob off, so I complained to the CAA about a month ago.

    I have just received a reply stating that due to the massive influx of compliants etc, their estimated time for dealing with this is now 20 weeks.

    I am reasonably happy to sit and wait. I know the small claims proc is reasonably stress free, but I'll see what happens with the CAA.

    That is beyond ludicrous. Give them 14 days and sue.

    If an EU airline you can still claim. If a non-EU airline you cannot
